<br /> <br />264 <br /> <br />The motion for the 9,dopti"l1 of the resolutien was <br />secended by Judge O'Rourke and. upon vote being taken. <br />was unanimously carried and declared adopted. <br /> <br />Thereupon Mr. Breitenstein reported with respeot to certain prooedure <br />which must be followed under the deaisien and deoree entered by the Supreme <br />Court of the United States in the North Platte Case (Nebraska vs. WYoming and <br />Colorado. United States, Intervener). He stated that the form of deoree <br />required Colorado to keep records with respeot to reservoir storage and irri- <br />gated acreage in the North Platte basin in Colorado; and he explained that <br />the Colorado Water Conservation Board, as the State agenoy in charge of <br />interstate water matters, should arrange, in cooperation with the State <br />Engineer, for the making of certain reservoir capacity and other neoessary <br />studies as well as for the keeping of these records. <br /> <br />After discussion, it was moved by Direotor Stone and <br />seoonded by Attorney General Hinkley that the Board de- <br />signate Jean S. Breitensteil1, attorney for the Board, who <br />,has aotively participated in the case; George J. Bailey, <br />who also participated in the oase and who represents this <br />Board in Jackson County, Colorado(the headwaters of the <br />North Platte River in this State); C. L. Patterson, Chief <br />Engineer of the Board, who prepared engineering data for <br />use i. the case, and M. C. Hinderlider, State Engineer, <br />as a committee to undertake the task of doing what is <br />immediately neoessary and to formulate a procedure to be <br />follewed by the State in the future in oarrying out the <br />recommendations which have been made by the attorney fer <br />the Board, and that the Beard authorize the expenditure <br />of the neoessary funds to do this work. <br /> <br />Upon vote being taken, the motion was unanimously <br />oarried and declared passed. <br /> <br />Mr. Stanley W. Lohman, of the U. S. Geologioal Survey, in oharge of <br />the underground water study in Colorado, reported on the status- of the <br />underground water investigation in this State under the cooperative oontraot <br />between Colorado and the U. S. Geological Survey. Mr. Patterson supplement- <br />ed Mr. Lohman's report. <br /> <br />! <br /> <br />The director reported that the engineers on the staff of the Board who <br />had entered the armed forces (five in number) were beginning to return to <br />civilian life and were asking to be reinstated in their former positions. <br />He explained that because of the "line appropriations" made to the Board by <br />the last Legislature, that some diffioulties would be encountered in re- <br />storing these men to their former positi ons. He pointed out ways in whioh <br />the reinstatement of these men might be aocGmplished. He recommended that <br />the polioy of the Board, established shortly after the United States, entered <br />the war, for retaining the posi ti ons on the Board's staff for service men <br />should be fully carried out. <br /> <br />After discussion, it was moved by Judge O'Rourke and <br />seoe.ded by Mr. Pughe that the matter be, referred to the <br />Director and to the Attc;rney, General to work out a plan t. <br /> <br />" <br /> <br />
