<br />MR. STAPLETON: Mr. Valdez, as you know, we had taken some action in <br />that regard, but your statement will be in written form in the minutes <br />of this meeting. Thank you. <br /> <br />MR. SPARKS: Mr. Valdez, I might add, since you were not able to be <br />here earlier; we reiterate our-statement that we will not.interfere- <br />with your water rights or anyone else's. We think you are fully <br />protect~d by the constitution and the laws _ of this state. <br /> <br />However; we made all offer this. morning to: the previous speaker on this <br />subject that if there are practices being carried on down there new <br />.in the way of water uses which are not embodied in~court decrees~ <br />we're willing to recognize whatever those~practicesare by stipu1ation~ <br />so that there's no question that we're not going to interfere with <br />your water rights. <br /> <br />So, if you can come up with any stipulation you would like us to enter <br />into with reference to yqur current practices, we would certainly enter <br />into such stipulations and give you all the protection which the-law <br />affords you.' <br /> <br />MR. VALDEZ: Well, I think. the stipulation that should be emphasized is <br />that the Division of Wildlife already has a one-tenth undivided interest <br />in.' all of the water, so for them to apply for any. additional water is- <br />facetious. ... . <br /> <br />The minimum stream flow concept should be: limited to the.right which <br />they already have, and that's the only stipulation which we can agree <br />with, and any other sort of compromise is., not feasible in out way of <br />thinking. ~... <br /> <br />. <br />MR. STAPLETON: Mr. Valdez, I suggest that with this offer maybe you <br />can get together with Mr; Sparks and see:ifthere is: some area you can <br />agree on that you. think will. be .he1pfu1.. STAPLETON: We will go to the consideration of the floodplain <br />reports, agenda item 3. Mr. Sparks, is there anything unusual in any <br />four of these flood information reports? <br /> <br />MR. SPARKS: Nothing unusual, Mr-. Chairman. These are standard flood <br />information reports prepared, particularly in.the case of the Big <br />Thompson, with very meticulous details, Because of the very.tragic <br />flood that occurred there on July 31st of the past year, we set up <br />some special procedures to identify thef160d hazard in that .area. <br /> <br />We had numerous agencies involved: . The county officials, the planning <br />officials in Larimer County. We brought in theUnite-d States Geo- <br />logical Survey, Bureau of. Reclamation, the Federal Insurance Adminis- <br />tration:and consulting firms. to agree upon a method of arriving at the <br />floodpl:ain hydrology of the Big Thompson Canyon.
