<br />The Upper Colorado River Compact is state law, having been adopted in 1949, codified . <br />as Article 62 of Title 37, ofthe Colorado Revised Statutes. Article VIII ofthe Upper <br />Colorado River Compact established the Upper Colorado River Commission as an <br />interstate administrative agency to be composed of one commissioner representing each <br />ofthe four states ofthe upper division. The Governor is authorized and required to <br />appoint a representative to the commission and to fix the compensation. The <br />Commissioner serves at the pleasure ofthe Governor in accordance with the laws of <br />Colorado and Governor Owens has appointed Mr. Balcomb pursuant to Executive Order <br />A 186 99 to serve as Colorado's representative to the Commission effective September <br />23,1999. The provisions of37-62-101 et. seq. and Section 37-60-101, et. seq. C.R.S. <br />govern this appointment. To date a "Purchase Order" has been issued annually to <br />compensate the Commissioner for his time and expenses as set by the Governor. <br /> <br />In the "Scope of Work" that follows, the duties assigned to the Upper Colorado River <br />Commissioner include the activities of which he has currently been participating. In as <br />much as Colorado's Upper Colorado River Compact Commission has a duty and <br />obligation to participate in the discussions described in the attached "Scope of Work" we <br />never-the-less believe it appropriate to make it very clear that Colorado's Commissioner <br />has full and complete authority to do so. <br /> <br />A. Background and General Scope of Work: <br /> <br />L <br /> <br />The Contractor will attend all meetings of the Upper Colorado River <br />Commission and the 7-Basin State meetings, to the extent practicable, and <br />maintain regular communication with the Commission, its Executive <br />Director, the Executive Director for the Colorado Department of Natural <br />Resources, the Director of the Colorado Water Conservation Board and <br />the Commission's advisors. The contractor my also maintain regular <br />communication with the representatives from the other parties to the <br />Upper Colorado River Compact, with representatives from the other states <br />and Tribes, and with others that comprise or derive water supplies from <br />the Colorado River system, <br /> <br />. <br /> <br />2. Attend and participate constructively in all meetings ofthe Colorado River <br />Policy Advisory Council established by Governor Owens under Executive <br />Order B 01799, which will be convened periodically by the Executive <br />Director of the Department of Natural Resources and Director of the <br />Colorado Water Conservation Board to involve key stakeholders in <br />essential briefings, discussion and strategy development; and <br /> <br />3. In representing the State of Colorado and its interests in matters related to <br />the Upper Colorado River Compact and the 7-Basin States, the Contractor <br />shall: <br /> <br />a. <br /> <br />Give special attention to the development of California's plan to <br />limit its depletions, both now and in the future, to its 4.4 million <br /> <br />. <br /> <br />Page 2 of3 <br />
