<br />" <br /> <br />. <br /> <br />. <br /> <br />. <br /> <br />Discussion <br /> <br />The Board Staff investigated the opposers claims with regard to water availability and <br />determined that the recommended instream flow amounts were supported, in part, by water <br />imported from South Saint Vrain Creek. Since this imported water cannot be relied upon <br />with any certainty, the Board Staff re-evaluated water availability in the Lefthand Creek <br />Basin and determined that the original recommended flow amounts needed to be adjusted <br />to reflect the following amounts and time periods: 14 cfs for the period May 1 to July 31, <br />7 cfs for the period August 1 to September 30, 3 cfs for the period October 1 to March 31, <br />and 7 cfs for the period April 1 to April 30. The Division of Wildlife has evaluated the <br />proposed flow amounts and has determined that the amounts are sufficient to preserve the <br />fishery in this reach of Lefthand Creek. <br /> <br />Proposed Stipulation <br /> <br />The attached stipulation, which has been accepted by the applicant and <br />recommended by the Attorney General's staff, provides that the Saint Vrain and Left Hand <br />Water Conservancy District will consent to the entry of a decree in the Board's case (which <br />includes the adjusted flow amounts), so long as the water rights decreed for instream flow <br />purposes on Lefthand Creek recognize the operation of the Lefthand Park, Gold Lake, and <br />Lake Isabelle Reservoir exchanges decreed in Case No. 89CW238. The Lefthand Ditch <br />Company has chosen not to stipulate to any specific terms and conditions and have indicated <br />their intent to sign off on the Board's proposed decree which includes the new <br />recommended flow amounts. <br /> <br />Staff Recommendation <br /> <br />The staff recommends that the Board ratify the attached stipulation with the Saint <br />Vrain and Lefthand Water Conservancy District. <br /> <br />DCM/JB <br />Attachments <br /> <br />186CW342.STP <br />
