Resources and the Colorado Water Conservation Board <br />(CWCB) is writing to inform you of the CWCB's intent to file on an instream flow right <br />on eight stream reaches within North Fork and Smith Fork river basins, Instream flow <br />appropriations are being considered by the CWCB for the following streams: <br /> <br />a. Muddy Creek (tributary to Paonia Reservoir}-Gunnison County <br />b. Anthracite Creek-Gunnison County <br />c. Coal Creek-Gunnison County <br />d. Williams Creek-Gunnison County <br />e. Muddy Creek (tributary to Crawford Reservoir}-Gunnison and Delta <br />Counties <br />f. Smith Fork Gunnison River-Gunnison and Delta Counties <br />g. South Fork Smith Fork Gunnison River-Gunnison County <br />h. North Fork Smith Fork Gunnison River-Gunnison County <br /> <br />An instream flow water right is an 'in-channel' appropriation of water (non- <br />consumptive) made exclusively by the CWCB for 'minimum flows' between specific <br />points on a stream to preserve the natural environment to a reasonable degree and is <br />administered within the State's water right priority system. <br /> <br />Section 37-92-102(3)(b) of the Colorado Revised Statutes provides that an instream <br />flow water right is subject to uses or exchanges of water (even ifnot decreed by the <br />water court) being made on the date the Colorado Water Conservation Board <br />appropriated the instream flow water right. In effect, this means that the instream flow <br />right will be administered as being junior to the existing use if certain procedures are <br />followed. A person claiming an existing use of water that falls under this statute must <br />provide an affidavit to the Board from a person with personal knowledge of the existing <br />use. The affidavit should set forth: <br /> <br />. the person's name and how the person obtained personal knowledge of the use; <br />. a full description of the amount diverted, months diverted and type of use; and <br />:: :;~~::-=~~ ~~?.~ ~~~ '1_u.'!p U1<::l1t:! n~l"l1rrin~ nn or ~hnnt the date that the CWCB <br />appropriated the ISF water right. <br /> <br />(over) <br />
