~U88

MR. NELSON:
MR. STAPLETON:

nary stage, we are not ready to agree with
the above broad unilateral contention', The
letter then quotes from the memorandum to
the Board - (from the resolution) ',..,that
the Secretary of the Interior be requested
to enter into an appropriate contract with
Crown Zellerbach Corporation for the delivery
of sufficient water from Green Mountain Res-
ervoir, Colorado, as will satisfy the water
requirements of said corporation in the opera-
tion of its proposed pulp mill;..,.,'.

The Northern Colorado District goes on to
say 'vIe cannot agree wi tll the b:,-:-ad general
statements made in some of the correspondence
above referred to'. They call attention to
the fact that some of the provisions of Senate
Document 80 are subject to the stipulation of the
United States District Court. They call
particular attention to that portion of Senate
Document 80 which provides as follows: 'The
cost of construction and perpetual operation
and maintenance of said reservoir or reser-
voirs shall be a charge against the project
and shall be paid from revenues collected from
this project as may be provided in contracts
between the Secretary of the Interior and the
beneficiaries of the project in eastern
Colorado, and any other contracting parties'.
It points out that the Northern Colorado Dis-
trict is paying one-half of the annual opera-
tion and maintenance and is a prime contractor
with the United States and has a definite in-
terest in any contracts; that it has not been
a party to the negotiations; feels that the
Northern Colorado District is a necessary
party; and winds up by saying that' Any such
contract should provide that any other con-
tracting parties would discontinue their
diversions and storage in advance of the
discontinuance of the diversions and utiliza-
tion of water by the Colorado-Big Thompson
Project or any of its components or units on
the eastern or western slopes of Colorado'.

I

I

That letter is dated August 11th."

"Mr. Chairman."

"Mr. Nelson."
