MR. JOHNSON:

"The payment that is being made is the
lack of fulfillment of the contracts for power
that have been made by the Secretary of the
Interior. He has made them; he has authority
to make them. He have been delivering al;L of
the water downstream. Now we are going to
get back to a delivery of 7,500,000 on an'
average each year. But they have let con-
tracts for far above that. They have let
contracts on the basis of probably an average
of 11,000,000 acre-feet of water per year.

Are we, through this amendment, ,agree-
ing that we have the responsibility of deliver-
ing water to the point of fulfilling all of the
power contracts that had been made by the
Secretary of the Interior?

Attorney Moses says, and he's a good
attorney and I respect his 9pinion very
much, does he mean by his explanation that
the moment that we begin making power at Glen
Canyon that the criteria is allover; it's
ended? The moment that we get up to 6.1 and
commence making energy ourselves at Glen
Canyon, does that bring an end to the cri-
teria?1I

MR. MOSES:

"That's my interpretation of the criteria,
that it is just to cover the periOd to get us
where we can generate power and once we reach
6.1 we are not required to release water below
that point. Now, please don't construe any-
thing I've said as being any agreement that
we have any obligation to make Hoover power
contractees whole. I don't believe it.
This criteria was imposed upon us; it was
not agreed to by the Upper Basin states; I
don't think it was agreed to by the Lower
Basin states. I think the Secretary (I
probably shouldn't say or attempt to say what
the Secretary thought) but it is apparent
