II <br /> <br />"Gentlemen, we previously forwarded to you <br />a memorandum on this subject. The major part <br />of our objection to the filling criteria which <br />was promulgated by the Secretary of the Inter- <br />ior was that the Upper Basin Fund was required <br />to make up the so-called power deficiencies <br />at Hoover Dam. As I stated in our memorandum, <br />we have been unable to find any authority, <br />either in law or contract, for the diversion <br />of Upper Basin funds for the benefit of power <br />contractors at Hoover Dam. This has been an <br />extremely sore spot with us. It is impossible <br />to determine, at this time, what the actual <br />drain on the Upper Basin Fund might be, but <br />certainly it appears that the drain on the <br />Fund in both power and money, together with <br />interest, will probably exceed $15 million. <br /> <br />The filling criteria provide that after <br />1987 it is hoped that Congress would approve <br />a return to the Basin Fund, in part, of the <br />monies diverted to the benefit of Hoover power <br />contractors. Certainly we have never felt <br />any obligation in the Upper Basin to deliver <br />water to generate power for the benefit of <br />the Hoover Dam contractors. This was a sore <br />point that Governor Johnson has stressed <br />
