September 19. 1991 <br /> <br />Call to Order (4774-4825, tape 1) <br /> <br />The rneeting was called back to order by Chairman Jackson and there was a quorum. <br />Present were Eisel, Harrison, Jackson, Smith, Sheftel, Walker, Danielson, Salazar, <br />Meyring, and Martineau. Absent were Lochhead, Wright, Norton, and Olson. Patricia <br />Bangert, Deputy AG, sat at the table for Norton. The Board decided to next consider <br />agenda items 8, llb, lla, and 12(d)(2). <br /> <br />8. Paradox Valley WCD . deferment of payment, continued (4840-5290, tape 1) <br /> <br />Sheftel was recused from the discussion due to a potential conflict of interest. Dale <br />Phippeny, Paradox Valley WCD, made a summary presentation to the Board. <br />Discussion followed by Jackson, Smith, Eisel, and Walker. A motion was made by <br />Martineau and seconded by Eisel to request a partial payment of $3,000 in 1991 and <br />to add the remaining $10,000 of the 1991 payment to the outstanding balance of the <br />loan to be paid back over the same repayment period. The motion passed by <br />unanirnous (7-0) decision with one abstention. <br /> <br />llb. Report on Matters in Litigation,AWDI Water Rights Application, Case No. 3-86CW46 <br />(5291-5300, tape 1) <br /> <br />David Walker, CWCB, summarized the presentation rnade by Brad Cameron, <br />Assistant Attorney General, during executive session. Additional discussion followed <br />by all CWCB rnembers present. This was an informational item and no action was <br />taken. <br /> <br />lla. Report on Matters in Litigation, Black Canyon National Monument Federal Reserved <br />Right (5301-5513, tape 1) <br /> <br />David Walker, CWCB, summarized the presentations made by Wendy Weiss, Assistant <br />Attorney General, and Gene Jencsok, CWCB staff, during executive session. <br />Additional discussion followed by all CWCB members present. A motion was made <br />by Harrison and seconded by Smith to contact appropriate officials with the Interior <br />Department, the Commissioner of Reclamation, the National Park Service, and the <br />U.S. Fish and Wildlife Service to object to the piecemeal negotiations on the reserved <br />right quantification. The Board is interested in a negotiation that also involves Section <br />7 consultation and involves a final quantification of the reserved right rather than just <br />instream flow operations on the Aspinall Unit. The motion passed by unanimous (8-0) <br />decision. <br /> <br />4 <br />
