<br />. <br /> <br />. <br /> <br />. <br /> <br />rnotion passed by unanimous (7-0) decision with one abstention. <br /> <br />A second motion was made by Sheftel and seconded by Eisel to approve the requested <br />one year sublease without an option for renewal, to request the U.S. Fish and Wildlife <br />Service and the USBR to review the issues surrounding the value of an instream flow <br />from an additional 10,000 acre-feet to the endangered fish in the IS-mile reach and <br />the effects upon recreation and power, and to urge all parties to pursue a <br />comprehensive basin-wide solution. The rnotion passed by unanimous (7-0) decision <br />with one abstention. <br /> <br />18. Instream Flow Program: Development of Rules and Regulations (2213-2835, tape 4) <br /> <br />David Walker, CWCB, introduced the subject. David Harrison noted that he was <br />participating only in the consideration of an interim policy on conditional decrees. <br />Discussion followed by Martineau and Eisel. Dave Miller, citizen, and Roger Flynn <br />for the Environmental Defense Fund made additional comments. A motion was made <br />by Martineau and seconded by Sheftel to adopt an interim policy and have the staff <br />prepare a written policy staternent for review by the next meeting. The motion passed <br />by unanimous (8-0) decision. <br /> <br />I2a,b,&c. Colorado River Matters, S1228 - Glen Canyon Legislation, Proposal by <br />California to resolve long term issues (2840-3548, tape 4) <br /> <br />Jim Lochhead, CWCB, reported on California's recent proposal. The Director was <br />asked to consider scheduling a special CWCB rneeting on October 10 or 17, 1991 to <br />discuss the California proposal in detail. <br /> <br />I9a,b&c. Instream Flow Program: Statements of Opposition (3590-3924, tape 4) <br /> <br />a. 2-91CW019 - Upper Arkansas WCD <br />b. 4-91CW049 - Mt. Crested Butte Water & Sanitation District <br />c. 5-91CW073 - Devil's Thurnb Joint Venture <br /> <br />David Harrison stated for the record that he represents the City of Salida, which is a <br />co-objector in the Upper Arkansas case, but that he did not see this as a potential <br />conflict of interest. Dan Merriman, CWCB staff, reviewed the above cases. Martineau <br />discussed item 19b and Meyring discussed itern 19c. A motion was made by Smith and <br />seconded by Martineau to approve the staff recommendation that the Board ratify the <br />statements of opposition filed in these cases to protect the Board's instream flow <br />rights. The rnotion passed by unanimous (7-0) decision. <br /> <br />8 <br />
