<br />Action: For the second group of streams, a motion was made by Don Schwindt with a <br />second by Harold Miskel to approve staff recommendation that the Board declare its <br />intent to appropriate Instrearn flow water rights on the remaining streams listed as <br />follows: <br /> <br />Division 4 <br />Cornet Creek <br />Bear Creek <br />San Miguel River <br />Horsefly Creek <br />Anthracite Creek <br />Muddy Creek (tributary to Paonia Reservoir) <br />Williams Creek <br />Escalante Creek (lower segment) <br />East Fork Escalante Creek <br /> <br />The Board requested Staffto provide a list of water rights located in or above all proposed new Instream <br />flow reaches. <br />Motion was approved 8-1 with Tom Sharp voting nay. Russell George was not present. <br /> <br />5. State Engineer's Office - Update on Revision of Colorado Dam Safety and Dam Construction Rules <br />Tape I, Track I 1:42:55 - 1:57:00 <br />Action: Information item. No formal action taken. <br /> <br />6. Update on the Feasibility Cost Share Agreement performance tasks, schedules and budget <br />Action: A motion was made by Tom Sharp with a second by Eric Wilkinson to approve staff <br />recommendation that the Board endorse the request by the Board, water users, and <br />interested parties that the Corps of Engineers, Omaha District (Corps) complete the <br />Chatfield Reservoir Reallocation Study by December 31, 2006. The Board further <br />recommends that the Corps make the Chatfield Reservoir Reallocation Study a high <br />priority in its annual budget request to congress. <br />Motion was approved 10 - O. <br /> <br />b. Presentation from the Chatfield Water Users Subcommittee and acceptance ofthe "Letter of <br />Commitment" relating to reallocation ofthe proposed water supply storage space. <br />Action: A motion was made by Eric Wilkinson with a second by Don Schwindt to approve staff <br />recommendations as follows: <br />1. Exhibit A will serve as the Board's storage space recommendation to the <br />Corps of Engineers, Omaha District pursuant to the State's duties and <br />responsibilities as outlined in the March and April 1979 Corps and State <br />Chatfield Project sponsorship agreements. <br />2. The "Letter of Commitment" (Letter) will serve as the Board's document when <br />fully executed to commit the Water Users to participate in funding to complete <br />the FCSA with the Corps. <br />3. By approving the recommendation of Exhibit A, the Board will acknowledge <br />the priority date regarding the right to storage in Chatfield Reservoir in <br />cooperation with the Corps of Engineers. Note: The Corps has requested the <br /> <br />Flood Protection. Water Project Planning and Finance. Stream and Lake Protection <br />Water Supply Protection. Conservation Planning <br />
