<br />I <br /> <br />Upper Basin is being required to deliver 750,000. <br />Never under any circumstances, in our opinion, <br />could the figure ever be 750,000. There is <br />always some water at the international boundary. <br />We therefore have strenuous objections at this <br />point in history at being assessed 750,000 acre- <br />feet as a result of the Mexican Treaty. At <br />Governor Love's request that figure was changed <br />to 8 million acre-feet. We realize that there <br />will be a period of time during the immediate <br />future in which we can probably deliver 8 <br />million or in some years in excess of 8 million <br />acre-feet without any damage to the Upper Basin. <br />It will be necessary in fact in order to provide <br />power revenues necessary to provide for Upper <br />Basin development. However, we do not wish to <br />be branded with the implication that 750,000 <br />acre-feet should be assessed against the Upper <br />Basin as an obligation under the Mexican Treaty. <br /> <br />I <br /> <br />What we did was modify the proposed cri- <br />teria to conform to the act of Congress. If a <br />situation exists where Lake Mead has greater <br />storage than Lake Powell, and there is sufficient <br />water for the Mexican Treaty and for the 75 <br />million at Lee Ferry, then releases would be <br />reduced to whatever figure is necessary in order <br />to bring Lake Powell up to the level of Lake <br />Mead. Or conversely, more than 8 million acre- <br />feet. perhaps 9 or 10 million acre-feet in some <br />years, may have to be released if it is necessary <br />to bring Lake Mead up to the level of Lake Powell. <br />These extreme conditions should not occur because <br />as nearly as possible there should be a uniform <br />release from Lake Powell in order to accomplish <br />the maximum generation of power. In any event, <br />the congressional act provides that releases <br />either go up or down, depending on the situation. <br /> <br />Other than that there were no significant <br />changes from what was previously submitted to <br />you. <br /> <br />That's my summary of this agenda item, Mr. <br />Chairman." <br />
