<br />"::::;CM LGRWCD <br /> <br />F;<X NO. <br /> <br />'=78 641 6727 <br /> <br />Mar. is :ee0 24:45~M P3 <br /> <br />Memorandum <br />Taylor Park Reservoir <br />November 1, 1993 <br /> <br />In 1986, water right applic:l.tions were filed by the City of Aurora (S6CW37) and <br />N'ECO (86CW226, conveyed to Arapahoe County in 8SCW178), that proposed to divert <br />water from Taylor Park to the east slope of Colorado. The Upper Gunnison Water <br />Conservancy Distri~ objected and filed competing applic:l.tions (86CWZ02 & 203) to <br />preserve the 1975 exchange agreement benefits. Litigation of these =es in the water court <br />resulted in Upper Gunnison receiving a decree in 86CW203 and a finding that only 20,000 <br />AF was available to 88CW178. The Supreme Court upheld the decree in 86CW203 but has <br />not ye;; heard arguments on appeal in 88CW178. <br /> <br />The state supported Upper Gunnison before the Supreme Court in 86CW203 and <br />has chosen not to side with any party on appeals in 88CW178. According to terms in a <br />stipulated agreement the water rights decreed in 86CW203 were transferred to Reclamation. <br />Reclamation holds all water rights. for Taylor Park Reservoir as well as the water rights for <br />the Aspinall Unit. <br /> <br />Given this background, it does not seem necessary nor appropriate to continue this <br />investigation.
