"::::;CM LGRWCD

F;<X NO.

'=78 641 6727

Mar. is :ee0 24:45~M P3

Memorandum
Taylor Park Reservoir
November 1, 1993

In 1986, water right applic:l.tions were filed by the City of Aurora (S6CW37) and
N'ECO (86CW226, conveyed to Arapahoe County in 8SCW178), that proposed to divert
water from Taylor Park to the east slope of Colorado. The Upper Gunnison Water
Conservancy Distri~ objected and filed competing applic:l.tions (86CWZ02 & 203) to
preserve the 1975 exchange agreement benefits. Litigation of these =es in the water court
resulted in Upper Gunnison receiving a decree in 86CW203 and a finding that only 20,000
AF was available to 88CW178. The Supreme Court upheld the decree in 86CW203 but has
not ye;; heard arguments on appeal in 88CW178.

The state supported Upper Gunnison before the Supreme Court in 86CW203 and
has chosen not to side with any party on appeals in 88CW178. According to terms in a
stipulated agreement the water rights decreed in 86CW203 were transferred to Reclamation.
Reclamation holds all water rights. for Taylor Park Reservoir as well as the water rights for
the Aspinall Unit.

Given this background, it does not seem necessary nor appropriate to continue this
investigation. I hope this and the attached memorandum adequately addresses the
committees concerns.

Attachment

:2
