<br />(2) In future fiscal years, the Grantee, whether the Colorado Water Congress or the newly . <br />established Foundation, shall submit an annual report prior to May 1 of each calendar <br />year identifying the previous year's accomplishments and a proposed plan of action for e <br />the next year. The proposed plan shall contain the fOllowing: (1) a description of the <br />tasks, (2) any updated long-term plans and timelines, (3) budgets and (4) a list of <br />future deliverables. The State may review and comment on the report and plans and <br />may amend this award or future grant awards to include such terms and conditions as <br />it deems necessary to ensure performance. <br /> <br />B. Time of performance. The Grantee recognizes that time is of the essence in the <br />performance of its obligations. The Grantee shall perform the duties for the completion of <br />the tasks listed in the Scope of Work within the specified time schedule. <br /> <br />C. Disbursement of funds. The CWCS shall disburse funds: <br /> <br />1. Within 30 days after the effective date of this contract, the Grantee shall <br />submit a written request for funds not exceeding $50,000. These funds are <br />to be used by the Grantee for expenses associated with establishing the <br />water education foundation and then, if any funds are remaining after the <br />foundation is established, to perform the tasks shown in the Scope of <br />Work. Thereafter, the Grantee shall submit a written request for <br />incremental payment of grant funds not exceeding $50,000 on or about <br />January 2, on March 3, on May 1, and payment of any remaining grant <br />funds on June 2 of 2003. <br /> <br />2. In succeeding fiscal years, when annual payments of $150,000 are <br />authorized, appropriated and otherwise made available beginning on July a <br />1, 2003, the Grantee shall submit written requests for incremental payment ., <br />of funds not exceeding $50,000 on July 1, on October 1 and on January 1, <br />until all funds are expended. <br /> <br />3. The Grantee shall submit quarterly statements, commencing on April 1, <br />2003, describing its expenditures and accounting for the use of the <br />provided funds. Each statement shall describe the tasks that have been <br />performed and the percentag~ of completion of each task by task number <br />as specified in the applicable scope of work. Such statements shall be <br />subject to review and approval by the State. Statements submitted to the <br />State and the Grantee by a newly established Foundation shall be deemed <br />to meet this submittal requirement. <br /> <br />D. Expenditure of Grant or Return of unused funds. Any of the initial $250,000 Grant <br />Award that is disbursed but not expended by the Grantee in accordance with the terms of <br />this Grant Award by June 30, 2004, shall be remitted to the cwes within 30 days of either <br />(1) completion of the Scope of Work, or (2) ~pon termination of the Grant by the State in <br />accordance with Paragraph E or F herein. <br /> <br />E. Termination of contract. The State shall review the activities of the Foundation <br />annually and is authorized to cease providing moneys in the following year if in its <br />discretion, after providing notice to the Grantee, the State determines the purposes for <br />which water education foundation was established have ceased. <br /> <br />F. Termination of contract for cause. If, by ar1Y cause, the Grantee fails to fulfill in a timely e <br />and proper manner its obligations under thil? Grant, or if the Grantee violates any of the <br />provisions of this contract, the State shall: thereupon have the right to terminate this <br />
