<br />J <br /> <br />e <br /> <br />e <br /> <br />e <br /> <br />AGREEMENT BE'IWEEN <br />THE COLORADO WATER CONGRESS AND <br />THE COLORADO FOUNDATION FOR WATER EDUCATION <br />FOR PERFORMANCE OF WATER EDUCATION <br />UTILIZING FUNDS FROM <br />THE COLORADO WATER CONSERVATION BOARD <br /> <br />THIS AGREEMENT is made and entered into as of November ____,2002, by and between <br />the Colorado Water Congress, a Colorado nonprofit corporation, whose address is 1580 Logan Street, <br />Suite 400, Denver, Colorado 80203 ("CWC") and The Colorado Foundation for Water Education, a <br />Colorado nonprofit corporation, whose interim address is 1580 Logan Street, Suite 400, Denver, <br />Colorado 80203 ("CFWE"). <br /> <br />RECITALS <br /> <br />A. Bill HB02-I152, Section 25(1), appropriates $250,000.00 to the Colorado Water Conservation <br />Board ("CWCB") for the establishment of a water education foundation and continued <br />support of water education programs by means of a grant to the CWe. The purpose of the <br />funding is to promote a better understanding of water issues through educational opportunities <br />and resources, so that Colorado citizens will understand water as a limited resource and will <br />make informed decisions. <br /> <br />B. <br /> <br />Following the establishment of the water education foundation, Bill HB02- I 152, Section 25(2), <br />authorizes CWCB to annually provide $150,000 from the water conservation board <br />construction fund to the water education foundation. <br /> <br />Bill HB02-I152, Section 25(4), provides that CWCB shall review annually the purposes of <br />Section 25 and authorizes CWCB to cease providing funds in the following year, by providing <br />notice to CWC that the purposes of Section 25 have ceased. In addition, CWCB may set <br />terms and conditions as it deems appropriate concerning the annual expenditure of moneys <br />under Section 25. <br /> <br />D. CFWE has been established as the water education foundation contemplated by Bill HB02- <br />I152, Section 25. <br /> <br />C. <br /> <br />E. The State of Colorado for the use and benefit of the Department of Natural Resources, <br />CWCB, and CWC intend to enter into Contract No. Cl50097 for the purpose of <br />implementing Bill HB02-1152, Section 25(1), under which $245,000 will be granted to CWC, <br />$5,000 having already been disbursed to CWC by CWCB for purposes of Bill HB02-1152, <br />Section 25. A copy of the proposed Contract No. C150097 is attached hereto as Exhibit A. <br /> <br />F. CWC and CFWE desire to enter into this Agreement for the purpose of jointly implementing <br />the provisions of Bill HB02-1152, Section 25, and creating the procedures through which the <br />CWCB funding provided to CWC under Contract No. C150097 is provided to CFWE. <br /> <br />AGREEMENT <br /> <br />In consideration of the mutual covenants and obligations herein expressed, CWC and CFWE <br />agree as follows. <br /> <br />1. Scope of Agreement. CWC shall enter into Contract No. Cl50097 with the State of <br />Colorado for the use and benefit of the Department of Natural Resources, CWCB, in substantially the <br />form attached hereto as Exhibit A. CWC hereby designates CFWE as the water education foundation <br />
