<br />2) <br /> <br />ISF segments, Staff will continue to work with the Pueblo Board of Water Works to try and <br />resolve any issues both parties may have, <br />Eagle Sky Foundation, Inc, (porzak Browning & Johnson LLP) - Contesting the Board's <br />proposed appropriation date of January 29, 1998, They contend the earliest appropriation <br />date that can lawfully be claimed by the CWCB is the date it actually makes the requisite <br />statutory finding and votes to file for the ISF water right, <br /> <br />e <br /> <br />Texas Creek <br />1) Helton and Williamsen, P.c, - Concerned about possible affect on future exchange potential <br />up Texas Creek. <br />2) Seegers (White & Jankowski) - Concerned about possible affect on existing water rights and <br />possibility of limiting future junior water rights and exchanges, May also affect future <br />changes of water rights, <br /> <br />Graneros and Greenhorn Creeks <br />1) The CWCB has received several letters in support of these to recommendations, <br /> <br />Reserved Water Right Issues <br />1) Some of these segments have also been included in the talks with the United States Forest <br />Service (USFS) regarding reserved water rights, <br /> <br />TECHNICAL INVESTIGATIONS <br /> <br />The enclosed packet of technical data forms the basis for the stafl's recommendations and reflects any <br />changes to the instream flow recommendations as a result of the 120 day Public review and Comment <br />Period. <br /> <br />e <br /> <br />Natural Ehvironment Studies <br /> <br />The BLM and CDOW have conducted field surveys of the fishery resources on these streams and <br />have found that a natural environment can be preserved on each of these streams, To quantify the <br />resources and to evaluate instream flow requirements, the CDOW and BLM collected biologic and <br />hydraulic data that were analyzed by the BLM, CDOW and Board staffs, Based on the results of <br />these analyses, the CDOW and BlM prepared recommendations of the amount of water necessary <br />to preserve the natural environment to a reasonable degree for each of the streams on the attached <br />list of Instream Flow Recommendations, <br /> <br />Water Availabilitv Studies <br /> <br />The CWCB staffhas conducted an evaluation of water availability for these streams, To determine <br />the amount of water physically available for the Board's appropriations, the staff analyzed available <br />USGS gage records, available streamflow models, and/or utilized appropriate standard methods to <br />develop a hydrograph of mean monthly flows for each recommendation, The staff also relied upon <br />the flow measurements made as part of the field survey as an indicator of the amount of water <br /> <br />Page 2 of3 <br /> <br />e <br />
