<br />e <br /> <br />e <br /> <br />e <br /> <br />MEMORANDUM <br /> <br />TO: Colorado Water Conservation Board Members <br /> <br />FROM: Dan Merriman <br />Mark Uppendahl <br /> <br />DATE: September 21-22, 1998 <br /> <br />SUBJECT: Agenda Item 9b, September 21-22, 1998, Board Meeting- <br />Instream Flow Program - New Appropriations <br />Notice to Appropriate Instream Flow Water Rights in Water Division 2 <br /> <br />GENERAL BACKGROUND <br /> <br />A Final Notice regarding the Board's Intent to Appropriate Instream Flow Water Rights was <br />distributed to the public on July 28, 1998, CWCB staff met with Steve Witte of the Division 2 <br />Engineer's Office on August 1, 1996, to discuss any water availability problems regarding the <br />proposed instream flow segments, As per the Procedures for New Instream Flow Appropriations <br />(procedures), adopted by the Board in May of 1997, the attached Phase III streams are being <br />proposed for Board appropriation, The Board at its January 1998 and May 1998, meetings, formed <br />its intent to appropriate the attached stream segments in Lake, Chaffee, Teller, Fremont, Park, Custer <br />and Pueblo Counties (see attached maps), At these meetings the proposed ISF segments were <br />advanced to the Public Review and Comment and Board Action Phase, or Phase III, <br /> <br />The public has had at least 120 days, to provide written and/or verbal comments to the Board and <br />staff, Please find attached comments received by the Board or staff during this time, The Bureau of <br />Land Management (BIM), USFS and/or the Colorado Division of Wildlife (CDOW) identified these <br />stream reaches for inclusion into the instream flow program, <br /> <br />Issues Regarding Specific Streams <br /> <br />Tennessee Creek <br />1) Pueblo Board of Water Works - Has provided the staff and Board with information regarding <br />their proposed plan to inundate the Junior Tennessee Creek and Senior East Tennessee Creek <br />Page 1 of3 <br />
