The District will supply the Division Engineer annually with estimates of consumptive use <br />under this Ef A Plan gathered from parties contracting with the District. This information may include, <br />for each Authorized Diversion, the name, address, phone and, if available, fax number and E-mail <br />address, of the property owner; the amount of water contracted for with the District; the approximate <br />square footage of lawns and gardens irrigated during the past year and anticipated for the upcoming <br />water year; the surface area of ponds on the property, for the past and upcoming water years; the <br />number of head oflivestock on the property, for the past and upcoming water years; other uses of water <br />during the past water year and anticipated for the upcoming water year; the well meter reading on <br />November I of prior water year. (fthe District cannot supply such information or the information is <br />deemed unreliable by the Division Engineer, then the Division Engineer may estimate consumptive use <br />in consultation with the District. <br /> <br />C. If any person who contracts with the District for water to be used under this Ef A Plan does <br />not report to the District regarding water usage as required by the District, the District shall so report <br />to the Division Engineer, and the Division Engineer may curtail the water uses authorized by the non- <br />reporting party's contract with the District. <br /> <br />D. The District shall designate a person to coordinate the amount and timing of reservoir releases <br />with the Division Engineer and shall submit an annual report containing information on diversions and <br />reservoir releases hereunder to the Division Engineer as required by the Division Engineer. <br /> <br />E. At the expense of the water user hereunder, each well under the EfA Plan shall be equipped <br />with a totalizing flow meter and each surface diversion shall have a measuring device as reasonably <br />required by the District and the Division Engineer for the proper administration of this Ef A Plan. <br /> <br />F. Inclusion within the District: Pursuant to C.R.S. SS 37-45-1 I8(1)(b)(l)(B) and -131, as <br />amended, to benefit from this Ef A Plan land must be included within the District. <br /> <br />7. General Operation of the EfA Plan: <br /> <br />A. The Ef A Plan provides, through releases from Groundhog Reservoir as required by the <br />Division Engineer, for the replacement of the consumptive use of Authorized Diversions under the Ef A <br />Plan, and 2) for MVIC to receive up to 400 AF of MI&D Water from McPhee Reservoir to fulfill the <br />Dolores Project's commitment to deliver an average annual 13,700 AF of Dolores Project irrigation <br />water to MVIC pursuant to the District Contract with MVIC For Adjustment of Water Rights and Sale <br />of the Use ofIrrigation Water dated September 23, 1977 ("District-MVIC Contract"). <br /> <br />B. The EfA Plan may augment water utilization for: stock watering, irrigation, domestic use, <br />municipal use, industrial use, commercial use, evaporation, firefighting, recreational use and piscatorial <br />use. <br /> <br />C. Water users in the Upper Dolores Basin, to be covered by this EfA Plan, must purchase <br />District MI&D water.
