<br />. <br /> <br />5. Plan for AUllmentation: <br /> <br />e <br /> <br />A. Amount of <br />Exchange: 400 AF annually' <br /> <br />B. Rate of Delivery: 20 c.f.s. <br /> <br />C. Priority Date: 25 AF Absolute (August 1985) <br />75 AF Conditional (August 1985) <br />300 AF (April 1991) <br />(Negotiations for the Upstream Agreement began in August 1985. In April <br />1991, the State Engineer's Office ("SEa") required that well permits have a <br />temporary substitute supply plan developed and approved by the SEa.) <br /> <br />D. Source: Dolores River System <br /> <br />E. Pursuant to the MVICIDWCD Agreement: I) MVIC will provide the District with the 400 <br />AF when the water is physically and legally available to MVIC in Groundhog Reservoir; and 2) the 400 <br />AF has the third internal ranking in Groundhog Reservoir. <br /> <br />F. Pursuant to the MVICIDWCD Agreement, MVIC will not call its Numbers 17 and 17(a) <br />Water Rights to the extent that the District can physically and legally provide MVIC with the water to <br />which it is entitled from McPhee Reservoir. <br /> <br />e <br /> <br />G. Basis fordeterminine amount ofreolacement water reauired: For purposes of this E/A Plan, <br />the consumptive uses of water set forth in Exhibit "C" will guide determination of consumptive use <br />under this EI A Plan. If an applicant for an Authorized Diversion ("Authorized Diversion Applicant" <br />or "AD Applicant") under the EI A Plan wishes to utilize engineering assumptions other than those <br />hereunder, AD Applicant may file an independent Plan for Augmentation or submit a qualified <br />engineering report to substantiate AD Applicant's needed diversions, and alternative engineering <br />assumptions to the District and the Division Engineer, Water Division 7, and reach agreement with the <br />District and the Division Engineer concerning the amount of water to be diverted and consumed. The <br />fact that a water user enters into a contract with the District in no way requires that water user to seek <br />to become an Authorized Diversion under this EI A Plan. The decision to apply to participate in this <br />EI A Plan is permissive, not mandatory. <br /> <br />6. Terms and Conditions of the E/A Plan: <br /> <br />A. The District shall develop an accounting system, acceptable to the Division Engineer, which <br />shall include annual diversions by users of water for domestic purposes and monthly diversions for <br />other water users under this EI A Plan, releases from McPhee and Groundhog Reservoirs, and any other <br /> <br />3 This represents the maximum amount of water will be depleted by the Authorized Diversions .. <br />hereunder. . <br /> <br />6 <br />
