Stream and Lake Protection - Litigation Settlement Proposal- Town of <br />Breckenridge <br />Tape 2 Start/Stop: 0837 - 1645 <br />Action: A motion was made by David Smith to accept the staff recommendation <br />that the Board enter into this stipulation, providing that the two concerns <br />listed in the Board memo relating to 1) documentation verifying use of <br />Miners Creek Water prior to 1980, including volumes of water, and 2) to <br />strengthen the "best efforts" language, and that if these actions were not <br />done, the Board would proceed to trial. The motion was seconded by Bob <br />Burr. The motion was amended to also show that the actions taken on this <br />issue would not be conditional on the action of the State Engineer's <br />Office taken in this case. The motion was approved (6-0). <br /> <br />14. Stream and Lake Protection - Policy Discussion - ISF Quantification Methods <br />Policy <br />Tape 2, Start/Stop: 2009 - 2879 <br />Action: Information item; no action taken. <br /> <br />Adjourn: 4:05 p.m. <br /> <br />Tuesday, May 22, 2001 <br /> <br />Call to Order <br /> <br />8:12 a.m. <br />A regular meeting of the Colorado Water Conservation Board was <br />reconvened at The Beaver Run Resort in Breckenridge, 80424-2115 at <br />8: 12 a.m. on Tuesday, May 22, 2001. The meeting was called to order by <br />Chairman Harold Miskel. Five voting members were present at the call to <br />order so a quorum was not present (at least six required). Board members <br />present on this date were Bob Burr, Harold Miskel, Donald Schwindt, <br />David Smith, Eric Wilkinson, State Engineer Hal Simpson, Felicity <br />Hannay and Jennifer Gimbel (representing the Attorney General), and Rod <br />Kuharich. <br /> <br />15a. Floodplain Protection Program - South Platte River Right-Of-Way Request- <br />Pitcher's Deck Construction <br />Tape 2, Start/Stop: 2879 - 4645 <br />Action: Due to lack of quorum, no action taken. Possible changes or alterations to <br />the applicant's plan were discussed. This item will again be discussed <br />return at the July meeting. The Staff will compile a list of all existing <br />easements and will make a presentation at the next meeting, and the Board <br />will plan to discuss guidelines/policies/legal aspects relating to easements. <br /> <br />15b.
