Box 729 <br />Monte Vista, CO 81144 <br />Telephone: (719) 852-2315 <br />Fax: (719) 852-0280 <br /> <br />~~~->JI. <br /> <br />Carol Redding, Manager <br /> <br />November 20, 1998 <br /> <br />Hand Delivered 11/20/98 <br /> <br />Rio Grande Headwater Restoration Project <br />c/o Mr. Doug Shriyer <br />4485 E U.S. Highway 160 & 285 <br />Monte Vista, CO 81144 <br /> <br />Dear Doug: <br /> <br />As you are aware, Amendment I, The Taxpayers' Bill of Rights (TABOR), may present a <br />substantial obstacle to the District's current plans to take on administration of the proposed Rio <br />Grande Headwater Restoration Project. <br /> <br />TABOR imposes various limits 'and requirements on the state and all Colorado local <br />governments (defined in Amendment 1 as "districts") and their activities that do not qualify as <br />"enterprises." Under Amendment 1, any of the following actions now requires prior yoter approval: <br />(a) an increase in a district's spending from one year to the next in excess of the rate of inflation. <br />plus a "lp"owth factor" that is based on the net percentage change in actual yalue.ofall real property <br />in the district from construction of taxable real property improyements, minus destruction of similar <br />improvements, and additions to, minus deletions from, taxable real property; (b) any increase in the <br />real property tax revenues of a local district from one year to the next in excess of inflation plus the <br />appropriate "growth factor" referred to in (a), above; (c) any new tax, tax rate increase, mill levy <br />increase, valuation for assessment ratio increase for a property class, extension of an expiring tax <br />or a tax jXllicy change directly causing a net tax revenue gain; and (d) creation of any multiple fiscal <br />year direct or indirect debt or other financial obligation whatsoever without adequate present cash <br />reserves pledged irrevocably and held for payments in all future fiscal years (except for refinancing <br />bonded indebtedness at a lower interest rate or adding new employees to existing pension plans). <br />Elections on such matters may only be held on the same day as a state general election, at the local <br />government's regular bi-annual election or on the first Tuesday in Noyember of odd-numbered <br />years, and must be conducted in accordance with the procedures described in TABOR. <br /> <br />Keith HoUand, President, Center, CO; Robert Felmlee, Vice President, Center, co,- Eric Ellithorpe, Secretary/Treasurer, Monte <br />VISta, CO; Directors: Gerald A.
