Dear Mr. Lang:

Thank you for taking the time to discuss the appropriate procedures to follow for us to acquire an
easement for constructing an improved outfall pipe to the South Platte River. Our site is the Waste
Management Transfer Station located along the west bank of the river located to the south of the
Union Avenue crossing within the City of Englewood. It is our intention to increase the outfall pipe
size from the existing 12-inch pipe to approximately a 42-inch pipe. A sketch of the easement
location is enclosed for your review.

One option that we would like to keep open is to leave the 12-inch in place and conSLrUct the
improved outfall adjacent to the existing pipe. Can you tell me if that is a viable option for us to
continue to consider?

On behalf of Waste Management of Colorado. we are hereby requesting CWCB to grant us an
easement for the storm sewer upgrade upon submitting the required supponing documentation and
paying the appropriate fees. It is our understanding that a drainage report and a lega] exhibit of the
easement are submittal documents. and a fee payment of $] per square foot of easement are required
before CWCD grants the easemcnt Wc cstimate the ensement size to be approximately] 200 square
feel using a 10 foot easement width. Please proceed ....ith bringing this requeSt to your Board to get
the process staned.

In the meantime. we will continue working toward completing the drainage report and preparing the
easement exhibit. Please let me know if there are any format requirementS for the easemcnt exhibit. or
if there is any other requirements that CWCB may have with our outfall design. We are currently in
the preliminary design phase for this outfall. and would like to be infomled about any other design
requirements. I haye talked with Ben Urbonas. who is with the UDFCD. and he told me about not
using granular bnckfill and ha'ing compaction requirements being 98'70 of Standard Proctor.

Please let me know if you need an)'thing else at this time. otherwise we will be in touch in the near
