<br />Z'l.~,,! <br /> <br />~i~"':r <br /> <br />.;-..~.+ <br />, <br /> <br />A. <br /> <br />If the pipeline from Blue Lake is damaged or otherwise shut down during the <br /> <br /> <br />summer, mid April through mid October period. and San Miguel River streamflows <br /> <br /> <br />above the confluence with Bear Creek are less than 6.5 cfs. the Town will ~elease <br /> <br />water from the outlet of Blue Lake into the upper Bridal Veil Creek basin. The <br /> <br /> <br />amount of release will be commensurate with the Town's direct flow diversions <br /> <br /> <br />from lower Bridal Veil Creek. The release of stored water will prevent injury to <br /> <br /> <br />ewes water rights and will limit the defined emergency eondnions to the winter, <br /> <br />mid October through mid Apnl period. <br /> <br />e <br /> <br />B. If the pipeline from Blue lake is damaged or otherwise shut down during the <br />winter, mid October through mid April period, and San Miguel River streamflows <br />above the confluence with Bear Creek are less than 6.5 cfs; the Town will declare <br />a potential emergency condition. The Town will Immediately notify the CWeB and <br />Colorado Division of Wildlife that direct flow diversions from Bridal Veil Creek may <br />be necessary If the Town still requires water following implementation of mitigation <br />steps outlined in C. and O. below. <br /> <br />C. <br /> <br />Prior to diverting water from Bridal Veil Creek under the described emergency <br />condition, the Town will first utilize the physical and legal water supplies available <br />at that time from it's water treatment facilities located on Mill Creek and Cornet <br />Creek or other available sources. Only if the water available from these sourcas is <br />insufficient, or if the treatment plants are inoperable for any reason and condition <br />D. below is met. will the Town divert water directlv from Bridal Veil Creek. <br /> <br />e <br /> <br />D. Additionallv, the Town will not divert from Bridal Veil Creek under the described <br /> <br /> <br />emergency condition until the Town Council has first implemented the water <br /> <br /> <br />conservation measures set forth in Section 13.30.040 of the Town's Water <br /> <br /> <br />Conservation Code. Implementation of the water conservation program will help <br /> <br /> <br />insure that the Town's water use during the temporary emergency condition will <br /> <br /> <br />be limited to amounts necessary for public health. safetY and welfare.
