If granted, the easement will not restrict any future <br />easements/activities within the CWCB project ROW because it will be a requirement that the <br />structure remain a portable structure. <br /> <br />. <br /> <br />Conditions for the Easement - If the easement is granted, the owner shall comply with the <br />following conditions: <br /> <br />1) TIME PERIOD - The EASEMENT shall be for a term of 25 years. <br /> <br />2) PERMITS - The owner shall be responsible for securing and monitoring all required <br />federal, state, and local permits pertaining to Colorado waters and streams, <br /> <br />3) INSURANCE COVERAGE - The CWCB shall be named as an additional insured, and <br />shall have coverage in the amounts established by the Colorado Governmental Inununity <br />Act - part one of article 10 of title 24, lOa eR.S., as amended, <br /> <br />4) FEE CONSIDERATIONS - A reconunendation will be made that is in compliance with <br />the standard fee consideration. <br /> <br />5) RECLAMATION OF THE SITE - A reclamation plan shall be developed and provided <br />to the CWCB for approval prior to the completion of the project. <br /> <br />6) <br /> <br />NON-EXCLUSIVE EASEMENT CLAUSE - Language will be stated in the easement <br />that will reserve the CWCB's right to grant additional easements on the same land <br />covered by this easement. <br /> <br />e <br /> <br />REQUESTED EASEMENT <br /> <br />Action Requested: <br />For the South Metro Fire Training Academy's request, an easement is requested for the <br />placement of a storage shed and supporting service area. This easement will subordinate to the <br />Koch Company easement which was granted at the January 20, 1998 Board meeting. The staff <br />has been in conununications with both parties and find that the two easements can work in <br />harmony within the CWCB project right-of way (ROW). The staff reconunends an easement <br />area of approximately 60' xlO' which is located adjacent of the Board's easterly ROW line, <br /> <br />2 <br /> <br />. <br />
