Billhymer, Executive Director <br /> <br />SUBJECT: Administrative Reforms to the Regulatory Program under Section 404 <br />of the Clean Water Act and Section 10 of the Rivers and Harbors Act. <br /> <br />We have received a copy of OMB's approved regulatory reform for the Sec- <br />tion 404, et al., permit programs. Since this is an important step in this <br />new administration's regulatory reform program, there is transmitted a copy <br />of the OMB directive. <br /> <br />Basically OMB directs: <br /> <br />A. That new Memoranda of Understanding be prepared by the Department of <br />the Army and those authorized commenting agencies within two months which will <br />seek to reduce delay in the 404 permit process and eliminate some of the con- <br />fusion in the review process. <br /> <br />B. That the final permit decision will generally be made by the District <br />Engineer. <br /> <br />C. That the time table set forth by OMB be followed. <br /> <br />D. That the Army evaluate state programs and issue general permits on a <br />state-wide basis for states having programs similar to the Army regulatory <br />program. <br /> <br />E. That the Army honor local decisions on zoning and land use matters <br />except where water quality, navigation, or other issues of national importance <br />are involved. <br /> <br />F. That EPA revise its Section 404 regulations to stimulate incentive <br />and reduce Federal over site. <br />
