<br />b. Floodway concept - The area of the Designated <br />Floodplain District which remains after all the area <br />that must be kept free of development so the base <br />flood can pass with no more than a .5 foot increase <br />in the water surface elevation or the energy grade <br />line, provided hazardous velocities are not <br />produced, has been set aside. <br /> <br />Permit Authority - The local body responsible for <br />interpreting and assuring the implementation and enforcement <br />of these regulations as set forth in Section 4. <br /> <br />Regulatory Flood Protection Elevation - The elevation one <br />(1.0) foot above the water surface elevation of the base <br />flood. <br /> <br />Start of Construction - The first placement of permanent <br />construction of a primary structure (other than a mobile <br />home) on a site, such as the pouring of slabs or footings or <br />first permanent framing of the structures or any work beyond <br />the stage of excavation. For mobile homes, "start of <br />construction" means the date of the affixing of the mobile <br />home to its permanent site or the date of completion of the <br />mobile home park, whichever is earlier. <br /> <br />Structure - A generally walled and roofed building that is <br />normally primarily above ground and affixed to a permanent <br />site, including earth sheltered structures, open pavilions, <br />mobile homes, gas and liquid storage tanks, agricultural <br />storage tanks for chemicals such as pestisides or <br />fertilizers, septic tanks, and sewage treatment facilities. <br /> <br />Substantial improvements - Any repair, reconstruction, or <br />improvement of a structure, the cost of which equals or <br />exceeds 50 percent of the market value of the structure <br />either (a) before the improvement or repair is started or, <br />(b) if the structure has been damaged and is being restored, <br />before the damage occurred. The term does not, however, <br />include either (1) any project for improvement of a <br />structure to comply with existing state or local health, <br />sanitary, or safety code specifications which are solely <br />necessary to assure safe living conditions or (2) any <br />alteration of a structure listed on the National Register of <br />Historic Places or on the Colorado State Historical <br />Society's list of historic places. <br /> <br />Use - Any man-made or man-caused activity, or structure on a <br />parcel of land, whether temporary or permanent. <br /> <br />Watercourse - A natural or artificial channel, depression, <br />dry wash, slough, gulch, arroyo, stream, creek, drainageway, <br />pond, reservoir, or lake in which water flows either <br />continuously, intermittently, or periodically. <br /> <br />-6- <br />
