4. It is understood that the Contr.aclor s11<111 not be responsible
[or weather forecast operations. Weather forecasting for the purpose
of detcn11ining if particul.ar events are suitable for precipitation
augmentation by cloud seeding shall be furnished to the Contractor by
Western Weather Consultants, Inc. of Durango) Colorado, on a contin-
uous basis during the period November 1,1977, through April 30, 1978.
Jt shall be the responsibility of the Contractor t.o establi.sh appro-
pri.ate communication and li.1.ison with Western Wenther Consultants,
lllc. to the end that completely unified and coordinated weather modi-
fication activities can be carried on as a joint responsibility of
the Contrac t~r and Wes tern Weather Consultants, Inc.

5. The ContrClctor shall at all time:=> chrring the performm1ce of
this contr-act maintain continuous liaison with the Director of the
Colorado i./atcr' Conservation Boal:d 01: such project coordinator as he
may designate.

6. Project opcriltions will be conducted under. the following
limitations, conditions and guidelines:

a. All weather syste.ms judged to be sui.table for seeding
by the Contractor will be seeded during the period of this
conln1ct.

b. All operations shall be carried on pursuant to the
provisions of Article 20J Title 36, Colorado Revised Statutes
1973, as amended, and more particularly as to the permits and
licellses rcquire<.l by that article..

c. The Contractor shall provide for appropriate public
infoDlIation sGrvice and receive public guidance to and from
such citizens advisory committees as may be established by the
State through the Colorado Water Conservation Board.

J. The COnlT.:lctor shall indemnify <lnd hold the stkee
harmless [loom any and all claims against it for damages result-
ing [rom any .Jcts, [unctions or operations to".modify weather
conducted by the Contractor) its agents or employees in the
alllount of One Heillion 1l01lars ($1,000,000). The Contractor
agrees to obtain linbility insurance in the amounts of One
"ilUon .Dollars ($1,000,000), which insurance specifically.

cOI~ducted by the Contractor, its agents or employees.

~.. The Contractor.shall cOlnply with the provisions and
contll.l1.011S of any pel:llllts issue.d to the State of Colorado by
any agency of the feeler.1l government concerning the conduct of
weather modification activities which are covered by this
contr<Jct, and sball further observe and comply with any laws
of the United St.ates \l1'h:i.ch mny be applicable to such weather
modification activities.

f. The Contr.:lctor shall coordinate and maintain appropriate
liaison with and furnish available information to such parties.
as may be designated by the Stn.te for the purposes of evaluating
moni.~oring and determi.ning the results of the program to be '
carr~ed on by the Contractor pursuant to this contract.
