<br />FINAL DECISION <br /> <br />Because the proposed project meets all of the requirements of S36-20-I12, CRS, it is <br />hereby determined that the permit is approved with the following conditions to be more fully <br />described in the terms and conditions of the permit: <br /> <br />I. The permit shall be limited to the purpose of augmenting snow for enhancement of <br />runoff for irrigation purposes. <br /> <br />2. Said permit shall be for the period from January 25, 2000, through May 31, 2001, <br />with conditional approval given for future years' operations for the six month <br />period from December 1 through May 31 beginning in the year 2001 and extending <br />through the year 2010, subject to the permit renewal requirements of S36-20- <br />114(2), CRS, and subject to the Colorado Weather Modification Rules and <br />Regulations. <br /> <br />3. The person in control of the project must maintain a high level of coordination by <br />consulting with and informing the federal agencies, state agencies, and local <br />governments listed under the terms and conditions of the permit. <br /> <br />4. The maximum rate of release of silver iodide from any single generator will be <br />limited to the rate reasonably necessary to achieve the intended results in the target <br />areas. <br /> <br />5. <br /> <br />The actual snow pack as measured by selected automated snotel sites will be <br />compared with the 30-year long-term average suspension criteria at least on a <br />weekly basis. <br /> <br />r- <br />, <br /> <br />6. The applicant must pay an annual commercial operation fee of2% of the annual <br />operating expenses, or approximately $100 in the first year. <br /> <br />7. The applicant must prepare written monthly progress reports and a final report at <br />the end of the project in accordance with the requirements of the permit. <br /> <br />8. The weather modification permit shall be further subject to such other terms and <br />conditions as are set forth in the permit. <br /> <br />9. Said permit shall be denominated Permit No. 2000-3. <br /> <br />10. Public notice of the intent to modify the weather shall be published as 'soon as <br />possible once per week during two consecutive weeks in the official newspapers of <br />Garfield and Chaffee counties. Depending on the response within a two week <br />period following the last date of publication, this permit may be modified or <br />suspended until any issues are satisfactorily resolved. <br /> <br />9 <br />
