<br />C. is scientifically and technically feasible [ 9 36-20-112 (3)(c), CRS], <br /> <br />D, does not involve a high degree of risk of substantial harm to land, people, <br />health, safety, property, water rights, or the environment [ 9 36-20-112 (3)( e), <br />CRS], <br /> <br />E. includes adequate safeguards to prevent substantial damages to land, <br />property, water rights, people, health, safety, or the environment [ 9 36-20- <br />112 (3)(f), CRS], <br /> <br />F, will not adversely affect another weather modification project [ 9 36-20-112 <br />(3)(g), CRS], and <br /> <br />Q, is designed to minimize risk and maximize economic benefits to the residents <br />of the area [ 9 36-20-112 (3)(h), CRS]. <br /> <br />FINAL DECISION <br /> <br />Because the proposed project meets all of the requirements of 936-20-112, CRS, it is hereby <br />determined that the pennit is approved with the following conditions to be more fully described in <br />the terms and conditions of the permit: <br /> <br />1. The permit shall be limited to the purpose of augmenting snow for enhanced <br />operation ofthe ski areas and for enhancement of runofffor irrigation purposes. <br /> <br />2, Said permit shall be for the period from November 1,1995, through March 31,1996, <br />with conditional approval given for future years' operations for the five month period <br />from November 1 through March 31 beginning in the years 1996, 1997, 1998, and <br />1999, subjectto the permit renewal requirements of section 36-20-114(2), CRS, and <br />subject to the Colorado Weather Modification Rules and Regulations, <br /> <br />3. The person in control of the project must maintain a high level of coordination by <br />consulting with and informing the federal agencies, state agencies, local <br />governments, and private entities listed under the terms and conditions of the permit. <br /> <br />4, The maximum rate of release of silver iodide from any single generator will be <br />limited to the rate reasonably necessary to achieve the intended results in the target <br />areas. <br /> <br />5, The actual snowpack as measured by selected automated "snotel" sites and snow- <br />courses will be compared with the 30-year long term average suspension criteria at <br />least on a monthly basis. <br /> <br />6, The applicant must pay the annual 2% commercial fee estimated in the first year at <br />approximately $2,000, <br /> <br />6 <br />
