<br />. . <br /> <br />H-11 INDEMNITY AND REPORTING ACCIDENTS <br /> <br />The Contractor shall indemnify and hold the Government harmless from any <br />and all losses, damages, or liability on account of personal injury, <br />death, or property damage, or claims for personal injury, death, or pro- <br />perty damage of any nature whatsoever and by whomsoever made, arising <br />out of the activities of the Contractor, its employees, subcontractors, <br />or agents under the contract, regardless of whether such claim, loss, <br />damage, actions, cause of actions, expense and/or liability may be <br />attributable to the fault, failure, or negligence of the Contractor, its <br />employees, subcontractors, or agents under the contract. <br /> <br />The Contractor shall promptly investigate and maintain a complete record <br />of all accidents resulting in personal injury, death, or property damage <br />incidental to performance of work under the contract. Loss of or damage <br />to Government equipment or property in the custody of the Contractor <br />shall be immediately reported to the Contracting Officer together with <br />full details relating to the incident. <br /> <br />H-12 AVAILABILITY OF REFERENCE DOCUMENTS--RECLAMATION (APR 1984) <br /> <br />Copies of the Federal Acquisition Regulations and other documents <br />referenced herein will be furnished to the Contractor on request. <br /> <br />H-7 <br />
