<br />. , <br /> <br />(g) The Contractor may not publish, translate, or release data first <br />produced in the performance of this contract, in whole or in part, in <br />any manner or form, or authorize others to do so, during performance of <br />work under this contract, unless prior written approval is given by the <br />Contracting Officer. Normally, such written approval may be given only <br />after submission of technical papers and reports in draft form by the <br />Contractor and written acceptance of technical papers and reports by the <br />Contracting Officer. <br /> <br />(h) Notwithstanding subparagraph G., above, if the Contractor is an <br />educational institution, the institution, an employee of, or a student <br />at the institution, may at any time publish a document based on work <br />performed, and data developed under this contract, provided that (I) the <br />Contractor submits an advance copy of the document to the Contracting <br />Officer at least 60 days prior to the planned publication date', and (2) <br />the document, solely in the judgment of the Contracting Otficer, does <br />not contain information detrimental to the interests of the Government. <br />If the Contracting Officer determines that h.(2), above, is applicable, <br />he shall have the right to refuse approval for pUblication. Specific <br />written approval must be given by the Contracting Officer before a docu- <br />ment may be published. <br /> <br />(i) Any approved publication or information released by the Contractor <br />must state that the data utilized were developed during performance of <br />work under this contract, and that the Government does not endorse the <br />publication or release. The document may not refer to a commercial pro- <br />duct, commercial firm, or a trade name, in such a way as to imply endor- <br />sement or approval by the Government. If data are used in a thesis for <br />a graduate degree, the author must furnish to the Contracting Officer, <br />free of charge, 50 copies (or fewer copies if agreed to by the <br />Contracting Officer) of the thesis. <br /> <br />(j) All data furnished to the Government under this contract which the <br />Contractor considers to be proprietary shall be so identified by an <br />appropriate written legend on the document, recording, drawing, computer <br />printout, etc., involved. <br /> <br />Any such data not marked with a proprietary legend will be considered to <br />be nonproprietary data subject to subparagraphs A. through E. and G. <br />through 1., above. Proprietary information will be retained in con- <br />fidential status by the Government, provided that such data (1) are not <br />generally known or available from other sources without obligation con- <br />cerning their confidentiality, (2) have not been made available by the <br />owner, and (3) are not already available to the Government without obli- <br />gation concerning its confidential ity. The Government shall have the <br />right to remove, cancel, correct, or ignore any marking not authorized <br />by the terms on any data furnished hereunder, if upon delivery of the <br />data the propriety of such marking is not substantiated by the <br />Contractor, in writing, to the satisfaction of the Contracting Officer. <br />The Contractor shall be notified of any such action contemplated under <br />this subparagraph J., and which will be taken if the Contractor fails to <br />respond thereto so as to substantiate the propriety of the marking <br />wi thi n 60 days. <br /> <br />H-6 <br />
