H-3 NEGOTIATED OVERHEAD RATES - FIXED CEILING RATE

(a) Notwithstanding the provisions of clause No. 1-5.1 of the Contract
Clauses entitled "Allowable Cost and Payment," a billing rate for
i ndi rect costs shall be percent of the base of for the
i ni ti a I peri od of the contract.

(b) A maximum negotiated ceiling for overhead rates of percent is
hereby established for the entire contract period. The Bureau will not
be obligated to pay any additional amount of overhead above the nego-
tiated rate nor will any burden cost, otherwise allowable under this
contract, incurred over and above the ceiling rate be applied to any
other Government contract.

(c) Allowability of costs and acceptability of cost allocation methods
sha 11 be determi ned in accordance with subpart 31. 2 or subpart 31. 3 of
the Federal Acquisition Regulations as in effect on the date of this
contract.

H-4 FACILITIES AND MATERIALS TO BE FURNISHED BY THE GOVERNMENT

All equipment and supplies to be utilized by the Contractor in perfor-
mance of work under this solicitation will be provided by the Government
with the exception of costs for road and oversnow vehicles required
for personnel transportation, personnel protective and survival
equipment, and food and personal supplies required for personnel on duty
at the field facilities.

H-5 ANNUAL REVIEW

The Bureau is obligated to fund the research for the first year.
Succeeding years will be contingent upon the availability of funds,
negotiation of costs based upon annual work plans, estimated costs for
the next 12-month period, and/or the Bureau's continuing need for the
research.

H-6 OBJECTIVE ACCOMPLISHMENT

If, at any time, the Contracting Officer considers that the objective of
this contract has been accomplished, in part or in whole, either through
this contract or other Bureau contracts, or through research performed
by others, the Contracting Officer, after prior consultation with the
Principal Investigator, shall have the right to reduce requirements and
contemplated funding or to terminate work performance and request pre-
paration of a final report by the Contractor. The Contractor shall be
given written notice of such termination. Notwithstanding the provision
of this contract as to estimated reimbursable costs, only such costs as
have been accrued by the Contractor before receipt of such notice of
termination shall be reimbursed to the Contractor, except costs of the
preparation of a final report.
