<br />"Operational Plan for Weather Modification Project, Western Kansas Weather <br />Modification," dated 1995 (the Operational Plan) submitted by the permittee as part <br />of its application for this permit. <br /> <br />2. The area over which the applicant will be allowed to conduct seeding operations in <br />Colorado shall be the area within Colorado bounded on the north by the northern <br />boundary of Cheyenne County, on the east by the Colorado-Kansas border, on the <br />south by the Colorado-Oklahoma border, and on the west by a line 35 statute miles <br />(30.4 nautical miles) west of and parallel to the Colorado-Kansas border. <br /> <br />3. The primary target area lies wholly within the State of Kansas and shall be that area <br />specified in section 2.1 of the Operational Plan. <br /> <br />4. Seeding in the project target area will be conducted only when it is likely to be <br />beneficial to the primary target area and only when wind and other meteorological <br />conditions are such that the seeding can be expected to not affect Colorado. <br /> <br />5. Not more than the number of seeder aircraft as specified in section 3.2 of the <br />Operational Plan shall be used. The aircraft shall be equipped with the seeding <br />devices specified in section 3.3 of the Operational Plan. <br /> <br />6. The permittee shall provide the Director of the Colorado Water Conservation Board <br />(the Director) with the name, address, and telephone number of each pilot before <br />seeding commences pursuant to this permit in 1995 and in each subsequent year that <br />this permit is renewed. The permittee shall promptly notify the Director in writing <br />of any changes in addresses or telephone numbers or in pilots. <br /> <br />7. The permittee shall not undertake, or shall suspend, seeding operations over <br />Colorado if: <br /> <br />a. Such operations would increase the potential for unusually heavy <br />precipitation or severe weather conditions anywhere in the State of Colorado; <br /> <br />b. Such operations would decrease normal precipitation beyond the range of <br />normal variability anywhere in the State of Colorado; <br /> <br />c. The Director orders suspension of seeding in Colorado for any reason. <br /> <br />8. The permittee shall maintain the following written reports on seeding activities in the <br />proj ect target area: <br /> <br />a. Form WM3, copy attached, or a summary thereof indicating on which days <br />and from how many aircraft seeding actually occurred, including a map <br />showing flight lines of seeding aircraft, shall be submitted bi-weekly to: <br /> <br />2 <br />
