3. The primary target area lies wholly within the State of
Kansas and shall be that area specified in section 2.1
of the operational Plan.

4. Seeding in the project target area will be conducted
only when it is likely to be beneficial to the primary
target area and only when wind conditions are such that
the seeding can be expected to not affect Colorado.

5. Not more than three aircraft shall be used. They shall
be equipped with the seeding devices specified in
section 3.3 of the Operational Plan.

6. The permittee shall provide the Director of the
Colorado Water Conservation Board (the Director) with
the name, address, and telephone number of each pilot
before seeding commences pursuant to this permit in
1990 and in each subsequent year that this permit is
renewed. The permittee shall promptly notify the
Director in writing of any changes in addresses or
telephone numbers or in pilots.

7. The permittee shall not undertake, or shall suspend,
seeding operations if:

a. Weather forecasts or actual storms produce
unusually heavy precipitation or severe weather
conditions in the project target area;

b. The Director orders suspension of seeding for any
reason.

8. The permittee shall maintain the following written
reports on seeding act~yities in the project target
area:

a. Form WM3 (copy attached) shall be submitted
bi-weekly to the Director.

b. Form WM3. or a summary thereof indicating on which
days and from how many aircraft seeding actually
occurred. shall be submitted bi-weekly:

1) To the official county newspapers in
Cheyenne, Kiowa, Prowers, and Baca
Counties. Colorado. and

2) To the Colorado State Patrol Communications
Center. 700 Kipling, Denver, Colorado,
telephone [phone].
