DECISION AND PERMIT

This matter came up at a pUblic meeting on November 9, 1981 at
l:JO p.m. at the Routt County Courthouse, Steamboat Sprin9s, Colorado.
Hearing officer was Barbara C. Welles, Director for Weather Modification
Program, Colorado Department of Natural Resources. The proceedings were
recorded by electronic recording equipment and are available for review
or transcription upon request.

The hearing officer was assisted at the hearin9 by Dr. G. Brant
Foote, member of the Weather Modification Advisory Committee.

Colorado State University, herein referred to as the Applicani,
represented by Professor Lewis O. Grant, Ft. Collins, Colorado.

Testimony was offered by persons in attendance at said hearing on
both sides of the application.

FINDINGS.DF.FACT

1. The Findings of Fact were predicated upon the careful review and
consideration of the following:

a. The original Application for Permit for Weather Modification
Activities, Form WM2, dated September 30, 1981 with an attached
map.

b. A tape recording of the hearing conducted in Steamboat Springs, ~
November 9, 1981.

c. Comments, written and oral, from citizens expressing an interest
in this Application.

d. Advice, comments, and recommendations of the Weather
Modification Advisory Committee tendered to the Executive
Director on November g, 1981 as well as comments subsequent to
that date.

e. Weather Modification Act of 1972, Article 20, Title 36, CRS 1973.

f. Weather Modification Rules and Regulations effective
September 12, 1973.
