Based on the information in the proposed Operational Plan, testimony provided at the public <br />hearing and the information reviewed in the administrative record, the proposed weather <br />modification operation: <br />A. Is conceived to provide and offers promise of providing economic benefits to the area in <br />terms of additional recreation opportunities, enhanced stream flow, reservoir storage and <br />snow pack in the area where the operation will be conducted and in the South Platte Basin <br />{g 36-20-112 (3)(a), CRS} <br />B. Is reasonably expected to benefit the people in the area where the operation will be <br />conducted {g 36-20-112 (3) (b), CRS} <br />C. Is scientifically and technically feasible {g 36-20-112 (3) (c), CRS} <br />D. Does not involve a high degree of risk of substantial harm to land, people, health, safety, <br />water rights or the environment {g 36-20-112 (3) (e), CRS} <br />E. Includes adequate safeguards to prevent substantial damages to land property, water rights, <br />people, health, or the environment {g 36-20-112 (3) (I), CRS} <br />F. Will not adversely affect another weather modification project {g 36-20-112 (3) (g), CRS} <br />G. Is designed to minimize risk and maximize economic benefits to the residents of the area. <br /> <br />FINAL DECISION <br /> <br />The proposed application, operational plan and project design meets the requirements of 9 36-20-112, <br />CRS, and it is hereby determined that the permit is approved with the following conditions that will be <br />more fully described in the Weather Modification Permit. <br /> <br />I. The permit shall be limited to the purpose of augmenting snow for enhanced snowpack and runoff. <br /> <br />2. Said permit shall be for the period from December 1,2002 through April 15, 2003 with <br />conditional approval given for future years operations for the five month period of December I <br />through April 15 in the years 2003- 2004, 2004-2005, 2005-2006, 2006-2007. The permit <br />automatically expires on April 15, 2007. <br /> <br />3. The person in control of the project must maintain a high level of coordination by consulting with <br />and informing project sponsors, federal and state agencies, local governments, and private entities <br />listed under the terms and conditions of the permit regarding operation of the project. NA WC will <br />be required to obtain any local permits that night be required to operate cloud seeding operations <br />in Gunnison COlll1ty. <br /> <br />4. The NA WC and Gunnison County should consider an analysis of stream gages April through July <br />for nuloff compared to nul off in a similar drainage not thought to be reasonably affected by cloud <br />seeding operations. <br /> <br />5. The maximum rate of release of silver iodide from any single generator will be limited to the rate <br />reasonable necessary to achieve the intended results in the target areas. <br /> <br />6. The actual snowpack as measured by selected automated "SNOTEL" sites and snow course will <br />be compared with the 30-year long-term average suspension criteria at least on a monthly basis by <br />the Gunnison County, and North American Weather Consultants Inc. and reported to the CWCB. <br />In, addition, a graphic illustration ofthe 30-year average, suspension criteria, and actual Snow <br />Water Equivalent for each SNOTEL and Snowcourse monitoring site.
