DECISION AND PERMIT

This matter, including all formal and informal documents and other sources
of data and information thereon, has been reviewed by Harris D. Sherman, Executive
Director of the Department of Natural Resources, State of Colorado, who herein
renders his decision. In his review the Executive Director has carefully considered
the following:

1. The Application for Permit for Weather Modification Activities,
Form WM2, undated, pertaining to activities of the applicant
during 1975.

2. The Application for Permit for Weather Modification Activities,
Form WM2, dated October 9, 1975, of the Applicant including the
Operational Plan therein, attached hereto as Exhibit "A" and
hereafter called the Application.

3. STATEMENT OF FINDINGS, CONCLUSIONS AND DECISION of the appointed
Hearing Officer, dated December 19, 1974.

4. Recorder's Transcript, dated November 15. 1974, of the hearing
of October 29, 1974.

5. Advice" and comments tendered by the Advisory Committee established
by"C.R.S. 1973 36-20-106 on October 22 and October 31, 1975. and
January 7, 1976.

6. The written approval by the Executive Director of the Applicants
application for activities in 1975, dated December 20, 1974.

7. The applicant's operational record for 1975.

8. Weather Modification Act of 1972, Article 20, Title 34, C.R.S. 1973.

FINDINGS .AND DETERMINATIONS

1. The application for activities during 1975 was conditionally approved
for a continuous time per~od including 1976.

2. The applicant's operational record for 1975 is satisfactory.

3. The applicant has not yet paid the apglicable permit fee required by
C,R.S. 197336-20-112 (1) (b). The fee. established by C.R.S. 197336-20-113 is
two hundred dollars ($200.00) while the applicant has tendered one hundred dollars
($100.00).

4. The fee for the 1975 pe~mit was not paid. The fee for 1975 is two
hundred dollars ($200.00) while one hundred dollars ($100.00) was paid.

5. The applicant has demonstrated that the person in control of the project
holds a valid weather modification license. .
