<br />DECISION AND PERMIT-Page 2 <br /> <br />2. The prepared program is under the sponsorship of parties listed in <br />Attachment A attached hereto. <br /> <br />3. The nature of the proposed program is to undertake a commercial weather <br />modification program within the project area to provide beneficial additional <br />water supplies for recreational, agricultural, municipal, and other uses. <br /> <br />4. The Applicant has demonstrated that the persons in control of the project <br />received valid weather modification licenses and those persons are Lawrence <br />M. Hjermstad, Richard A. Medenwaldt, and Curtis L. Hartzell. <br /> <br />5. The applicable permit fee is $2883.51. <br /> <br />6. The Applicant has furnished proof of financial responsibility. <br /> <br />7. The Applicant has submitted an operation plan for the proposed project which <br />plan meets the requirements of C.R.S. 1973, 36-20-ll2(1)(d) and which is <br />incorporated into these findings by reference. <br /> <br />8. The Applicant issued a Notice of Intent to modify the weather pursuant to <br />the above said hearing in conformance with C.R.S. 1973 36-20-112(1)(e). <br /> <br />9. Said Notice of Intent was circulated to County Commissioners and newspapers <br />in the following manner: <br /> <br />a. Notice of Intent and Permit applications were on file in the <br />office of County Commissioners in at least five locations well <br />distributed within the affected area. A listing of offices is <br />available in the office of the Executive Director, Department <br />of Natural Resources, 1313 Sherman Street, #718, Denver, Colo- <br />rado 80203. <br /> <br />b. Notice of permit application and the SCheduled hearings was <br />circulated and published in newspapers in 9 counties. A <br />listing of newspapers is available in the Office of the Exec- <br />utive Director, Department of Natural Resources. <br /> <br />10. The Applicant has met the requirements of the Weather Modification Act <br />regarding publication. <br /> <br />11. The project is conceived and offers promise of providing economic benefit <br />to the area in which the operation will be conducted. The recommendation of <br />the Weather Modification Advisory Committee supports this finding. <br /> <br />12. The project is reasonably expected to benefit people in the area and benefit <br />the people of the State of Colorado. The recommendation of the Weather Modifi- <br />cation Advisory Committee supports this finding. <br /> <br />13. The project is scientifically and technically feasible. The recommendation <br />of the Weather Modification Advisory Committee generally supports this finding. <br /> <br />14. The project does not involve a high degree of risk of substantial harm to <br />land, people, health, safety, property, or the environment. THe recommendation <br />of the Weather Modification Advisory Committee supports this finding. <br /> <br />15. The project, subject to the terms and conditions of the permit, is <br />designed to include adequate safeguards to prevent substantial harm to land, <br />people, health, .safety, property, or the environment. The recommendation of the <br />Weather Modification Advisory Committee supports this finding. <br /> <br />16. The project will not adversely affect another project, subject to the terms <br />and conditions of the permit. The recommendation of the Weather Modtfication <br />Advisory Committee supports this finding. \ <br />
