Nov.9,1978- <br />Mar. 31, 1979. <br /> <br />DECISION AND PERMIT <br /> <br />This matter came on for public hearing on October 5, 1978 before <br />Harris D. Sherman, Executive Director, Colorado Department of Natural <br />Resources at 4:45 p.m. Lions Square Lodge, Vail, Colorado. The proceedings <br />were recorded by electronic recording equipment and are available for review <br />or transcription upon request. <br /> <br />The Director was assisted at the hearing by the following members <br />of the Weather Modification Advisory Committee: <br /> <br />Dr. Hugo Ferchau <br />Dr. G. Brant Foote <br />Dr. Archie Kahan <br />Dr. Guy Mock <br />Mr. Delmar Nelson <br />Mr ~ Charles Steele <br /> <br />Western Weather Consultants, herein referred to as the Applicant, was <br />represented by Mr. Frank S. Maynes, Attorney at Law, Durango, Colorado, at the <br />request of the Applicant. <br /> <br />The Applicant called the following witnesses: <br /> <br />Lawrence M. Hjermstad, Durango <br />Dr. Herbert Owen, Salida <br /> <br />Testimony was offered by persons in attendance of said hearing on <br />both sides of the application. <br /> <br />FINDINGS OF FACT <br /> <br />1. The Findings of Fact were predicated upon the careful review and consideration <br />of the following: <br /> <br />B. The original Application for Permit for Weather Modification <br />Activities, Form WM2, dated August 25, 1978 and the amended <br />application (to include Jackson County) dated October 18, 1978, <br />with an attached map. <br />b. A tape recording of the hearing conducted in Vail on <br />October 5, 1978 and a tape recording of the public meeting <br />conducted in Walden on October 24, 1978. <br /> <br />c. Comments, written and oral, from citizens expressing an <br />interest in this Application. <br /> <br />d. Advice, comments, and recommendations of the Weather Modi- <br />fication Advisory Committee tendered to the Executive <br />Director on October S, 1978 as well as comments subsequent <br />to that date. <br /> <br />e. Weather Modification Act of 1972, Article 20, Title 36, C.R.S. 1973. <br />
