<br />Applicant is aware of no circumstance in which persons, property or natural resources, have <br />been injured or harmed as a direct result of the operation hail cannon(s) such as that described <br />in this application (including those presently operated in Center, Colorado under Permit No. <br />96-5, described above). Accordingly, applicant is aware of no risk that the operation of the <br />proposed hail cannon could cause substantial harm to land, water, people, health, safety, <br />property and/or the environment. <br /> <br />9. Safeguards to be used by the operator to prevent substantial harm to land water people <br />health safety property and the environment. <br /> <br />Applicant proposes the following safeguards (please see conditions enumerated in State of <br />Colorado Weather Modification Permit # 96-5 for Hail Cannons installed in Center, <br />Colorado): <br /> <br />a. Operation of the Hail Cannon will be conducted (1) for testing purposes as necessary <br />for the proper operation of the device or as required by the Director of the Colorado <br />Water Conservation Board and Department of Natural Resources ("Director"), or (2) <br />only under conditions when the use of the Hail Cannon is likely to be beneficial in the <br />target area. <br /> <br />b. The applicant shall install the following sound protection measures intended to <br />rnitigate the effects of excessive sound at residential locations; <br /> <br />(1) The Hail Cannon will be surrounded by a sound barrier at least sixteen <br />(16) feet high. The sound barrier may be constructed of straw or hay <br />bails at least four (4) feet wide. <br />(2) If a decibel reading at any residence exceeds the limit for the threshold <br />of hearing loss duj;. to long term exposure as determined by the <br />Colorado Department of Health, the sound protection measure shall <br />be improved until the sound levels are within acceptable limits. <br />(3) A qua1ified expert shall conduct a sound test which shall sample the <br />sound level(s) at certain residences located one (1) mile of the Cannon <br />at the beginning of the initial project operating period. The sound <br />level at any residence shall not exceed eighty (80) decibels. <br /> <br />c. The applicant shall not undertake, or shall suspend operations if: <br /> <br />(1) Low flying aircraft are above the Cannon, <br />(2) Birds are visible flying immediately above the Cannon, or <br />(3) The Director orders suspension for failure to comply with the <br />conditions of the Permit. <br /> <br />3 <br />
