Smith <br />April 8. 1988 <br />Page two <br /> <br />Your request to change item numbered 2 of the "Terms and <br />Conditions" of Permit No. 84-3 from 10 to 30 nautical miles is <br />denied. This is because a permit can be renewed only if the <br />"conditions under which the permit was issued have not changed <br />substantially" (see paragraph C.(4) of the rules and <br />regulations). The requested change would be. I find. <br />substantial and it therefore cannot be made as part of this <br />permit renewal. The expansion to 30 nautical miles could be <br />sought only through an entirely new permit. the issuance of <br />which would be subject to the notice. hearing. and <br />determination requirements of section 36-20-112. CRS. <br /> <br />The granting of this permit renewal is made expressly <br />contingent upon your check for the permit fee being cleared by <br />your bank when presented for payment and upon receipt by me of <br />evidence of weather modification liability insurance being held <br />by you or the Western Kansas Groundwater Management District <br />No. 1 for the purposes of this operation in the amount of $2 <br />million with the State of Colorado as a named beneficiary, <br />Said insurance pOlicy must be with an insurance company <br />licensed to do business in Colorado and otherwise in compliance <br />with section 36-20-112(1)(C). CRS. <br /> <br />All reports required by the original permit and by statute <br />shall be forwarded to me.
