<br />. <br /> <br />18. Opposition to the application based upon a fear that a strong E1 Nino will cause excessive <br />precipitation to fall in the region is not sufficient grounds for denying the permit. The <br />application of suspension criteria to the long-term average snowpack measured in the target <br />area, will keep additional snowfall due to the weather modification program within <br />reasonable limits. <br /> <br />19. Based on the information in the proposed operational plan, testimony provided at the public <br />hearing, and the information and materials reviewed in the administrative record, the project: <br /> <br />A. is reasonably expected to benefit the people in the area in which the operation will <br />be conducted and the people of the state of Colorado by augmenting snow to provide <br />additional snowmelt runoff for irrigation and municipal purposes [ 9 36-20-112 <br />(3)(b), CRS], <br /> <br />B. is scientifically and technically feasible [ 9 36-20-112 (3)(c), CRS], <br /> <br />C. does not involve a high degree of risk of substantial harm to land, people, health, <br />safety, property, water rights, or the enviromnent [ 9 36-20-112 (3)(e), CRS], <br /> <br />D. includes adequate safeguards to prevenfsubstantial damages to land, property, water <br />rights, people, health, safety, or the enviromnent [ 9 36-20-112 (3)(t), CRS], <br /> <br />E. will not adversely affect another weather modification project [ 9 36-20-112 (3)(g), <br />CRS], and <br /> <br />F. is designed to minimize risk and maximize economic benefits to the residents of the <br />area [ 9 36-20-112 (3)(h), CRS]. <br /> <br />DECISION <br /> <br />Because the proposed project meets all of the requirements of 9 36-20-112, CRS, it is hereby <br />determined that the permit is approved with the following conditions to be more fully described in <br />the terms and conditions of the permit: <br /> <br />1. The permit shall be limited to the purpose of augmenting snow for enhancement of snowmelt <br />runoff for irrigation and municipal purposes. <br /> <br />2. Said permit shall be for the period from November 1,1998, through May 31, 1999, with <br />approval given for future years' operations for the seven month period from November 1 <br />through May 31 beginning in the years 1999, 2000, and 2001 subject to the permit renewal <br />requirements of section 36-20-114(2), CRS, and subject to the Colorado Weather <br />Modification Rules and Regulations. <br /> <br />3. The person in control of the project must maintain a high level of coordination by <br /> <br />7 <br />
