<br />resources, State. of Colorado, under date of February 10, 1977, <br />which permit is attached hereto and made a part .of this con- . <br />tract as Appendix B. . <br /> <br />e. Hold and save the State.free from any damages which might <br />accrue as a result of the project which is' the subject of. <br />this contract by appropriate agreements with any subcontractors. <br /> <br />f. At the conclusion of the program, the Contractor shall <br />prepare an operational summary of the program with some <br />comparative values of precipitation that occurred within and <br />"adjacent to the project 'areas, and shall prepare interim. . <br />summaries of the program on a monthly basis commencing with <br />the month ending in .February., 1977. <br /> <br />4. The program shall be initiated as early a.s practicable. during <br />the month of .February, 1977, and shall terminate on May 15, 1977. <br /> <br />5. For the foregoing p;rogram and .services, the State -shall pay to <br />the Contractor the sum,of $147,000, due and.payable to the Contractor <br />immediately following the execution of this agreement and subdivided <br />into the following approximate amounts, purposes', and conditions: <br /> <br />a. .Approximately $75,000, pIus or minus so much the~eof as <br />is necessary, :for payment to Colorado IJ;lternational Corporation- <br />Aero Systems. <br /> <br />:b. App;roxirnately $52,000, pIus or minus so much thereof as is. <br />necessary, for payment to W~stern Weather'Consu~tants. <br /> <br />c. Approximately $20,000, pIus or minus so much thereof as <br />is necessary, to' the.. Contractor for the control, monitoring <br />and evaluation of the total program herein described. <br /> <br />d.. Any sums .notexpended by the Contractor as the result of. <br />the use of less chemicals than is now estimated, or for. less' <br />flying hours than now estimated, or fo~ any other reason, <br />shall be returned to. the State at the. conclusion of the program, <br />along wit~ an itemized statement for all expenditures made. <br /> <br />6. While. H.B. 1160 recites and appropriates various non-state <br />funds for the program, payment or collection of such non-,state funds . <br />shall in no way be the liability or responsibility of .the State;. provided <br />that. if such funds are received by the State they will be paid over to <br />the Contractor/or subcontractors as appropriate to the agreement between <br />the Contractor and subcontractors, .or as the State might otherwise <br />detennine. <br /> <br />Page 2 of ~ pages <br />
