requirements of section 36-20-112(1)(d), C.R.S.

12. The project, under the terms and conditions of the permit:

A. Is conceived to provide, and offers promise of providing, an economic benefit
to the primary target area,

B. Is reasonably expected to benefit the people in the primary target area,

C. Is scientifically and technically feasible,

D. Does not involve a high degree of risk of substantial harm to land, people,
health, safety, property, water rights, or the environment.

E. Includes adequate safeguards to prevent substantial damages to land,
property, water rights, people, health, safety, or the environment, and

F. Is designed to minimize risk and maximize economic benefits to the residents
of the primary target area.

DECISION

In consideration of the requirements of section 36-20-112, C.R.S., and the above stated
findings, it is hereby detennined that a weather modification permit shall be issued to the applicant
subject to such terms and conditions as are set forth in the pennit. Said pennit shall be denominated
Pennit No. 95-5 and shall be for the period from May 20, 1995, through September 30, 1995, with
conditional approval given for future year's operations from April 15 through September 30 of 1996,
1997,1998, and 1999, subject to the pennit renewal requirements of section 36-20-114(2), CRS.,
and of the Colorado Weather Modification Rules and Regulations.
