<br />amended. <br /> <br />p. Colorado Weather Modification Rules and Regulations dated August 1, 1986,2 CCR <br />401-1. <br /> <br />FINDINGS <br /> <br />1. Application for a weather modification permit has been properly made by the <br />Western Kansas Groundwater Management District No.1 of Scott City, Kansas. <br /> <br />2. The sponsor of the project is the said district. <br /> <br />3. The person in charge of the project for the district will be Curtis D. Smith, who holds <br />a valid Colorado weather modification license for calendar year 1995. <br /> <br />4. The permit fee of $100.00 has been paid by check No. 4636 dated March 10, 1995. <br /> <br />5. Proof of financial responsibility has been provided by the applicant by means of a <br />Certificate of Insurance dated April 19, 1995, which evidences that the applicant is <br />covered by property damage liability insurance in the amount of $1 million through <br />Reliance Insurance Company of Illinois. <br /> <br />6. Legal notice of intent to modify weather was published on April 27 and May 4, 1995 <br />in the official newspapers of Baca, Cheyenne, and Kit Carson Counties and on April <br />28 and May 5, 1995 in the official newspapers of Kiowa ,and Prowers Counties. <br /> <br />7. A public hearing on the application was held at 1:00 p.m. on May 5,1995, in Lamar, <br />Colorado, this being not more than one week following completion of the publication <br />oflegal notice. <br /> <br />8. The area over which the applicant will be allowed to conduct seeding operations in <br />Colorado is the area within Colorado bounded on the north by the northern boundary <br />of Kit Carson County, on the east by the Colorado-Kansas border, on the south by the <br />Colorado-Oklahoma border, and on the west by a line 35 statute miles (30.4 nautical <br />miles) west of and parallel to the Colorado-Kansas border. <br /> <br />9. The project is intended to suppress hail in several counties in western Kansas (the <br />primary target area) in a manner that can be reasonably expected to not harm <br />Colorado. <br /> <br />10. The State of Kansas is in support of the project and does not prohibit weather control <br />operations to be carried on in that state for the benefit of Colorado or its inhabitants. <br /> <br />11. The operational plan for the project submitted by the applicant meets the <br />
