<br />~ <br /> <br />. <br /> <br />. <br /> <br />Mr. Keith Lebbin <br />April 10, 1989 <br />Page two <br /> <br />operational record and I do hereby waive the procedures for <br />initial issuance of a permit, which waiver is authorized by <br />section 36-20-114 (2), CRS. <br /> <br />The granting of this permit renewal is made expressly <br />contingent upon your check for the permit fee being cleared by <br />your bank when presented for payment and upon weather <br />modification liability insurance being maintained for the <br />purposes of this operation in the amount of $1 million with the <br />State of Colorado as a named beneficiary. Said insurance <br />pOlicy must be with an insurance company licensed to do <br />business in Colorado and otherwise in compliance with section <br />36-20-112(1)(c), CRS. <br /> <br />All reports required by the original permit and by statute <br />shall be forwarded to me. <br /> <br />Please be advised that this is the last time that Permit <br />No. 84-3 can be renewed given the five year limitation on <br />renewals found in section c(4), 2 CCR401-1. Should you want to <br />operate next summer, an entirely new permit would be required, <br />the issuance of whiCh would be subject to the notice, hearing, <br />and determination requirements of section 36-20-112, CRS. <br /> <br />As I informed Mr. Curtis Smith last year, the Department of <br />Natural Resources has not been receiving appropriations from <br />the legislature to administer this program. Thus, it has been <br />the department's position for the last three years that it <br />would not grant new permits, only renew existing ones. In <br />light of this situation, I would suggest that you contact me <br />early next fall to find out whether the department would be <br />willing to take the necessary steps to act upon an application <br />for a new permit.
