Thus, subject to modifications as described below, AGUA <br />will claim a 60.6 percent replacement credit for water returned to the Arkansas River as measured at <br />the augmentation station. Credits will only be claimed during the period of March 16 through <br />November 14. No credits will be claimed in this plan during the winter storage season of November <br />15 through March 15. <br /> <br />The proposed operation of the Excelsior Ditch for replacement purposes was negotiated <br /> <br /> <br />between Mr. Dick Evans, owner and representative of the Excelsior Ditch shares, and the Division <br /> <br /> <br />Engineer's Office. Two scenarios are envisioned and provisions for determining the appropriate <br /> <br /> <br />replacement credit in each case are proposed, as follows: <br /> <br />Case I: <br /> <br />If monthly augmentation releases (V RET)' the volume of water released from the ditch <br />to the Arkansas River through the augmentation station, are less than or equal to the <br />theoretical augmentation diversions (V,J, where V A is 35.61 percent of the total <br />amount diverted into the ditch during the month 01 DlV)' the augmentation credit is <br />equal to 60.6 percent ofVRET. <br /> <br />Case 2: <br /> <br />If monthly augmentation releases (V RET)' are greater than the theoretical <br />augmentation diversions (V,J, then the total possible augmentation credit is equal to <br />60.6 percent of V A> however, the actual credit is limited to 60.6 percent of35.6l <br />percent of the historical average diversions for that month (V HIST)' Values for V HIST <br />are the pre-Compact average monthly diversions for each month during the period of <br />March through November. The values are shown in the upper portion of Table 10. <br /> <br />For purposes of evaluation of this plan, the Excelsior Ditch credits estimated to be available <br />during the 1997 plan year are based on 60.6 percent of 35_61 percent of the 1908-1985 average <br />historical monthly diversions as shown in the lower portion of Table 10.
