Due to
its junior priorities, the firm yield of the Excelsior Ditch is zero as evidenced by the lack of
diversions in 1977. However, because of the above average water supply that is anticipated in the
Arkansas River basin during the 1997 irrigation season, the Excelsior Ditch is expected to be in
priority to divert at least its average annual historic amount.

AGUA is obtaining agreements with two owners of Excelsior Ditch shares allowing it to use
a portion of their shares for augmentation purposes. Pursuant to these agreements AGUA will have
control of 1,007 shares from Mr. Dick Evans plus 180 shares from Southwest Ready Mix for a total
of 1,187 shares out of3,333 shares outstanding (35.61 percent), The remaining 2,146 shares (64.39
percent) will remain in irrigation use. Copies of the agreements will be forwarded to the Division
Engineer's Office prior to March 31, 1997.

Water available in priority will be diverted at the Excelsior Ditch and measured through the

main ditch flume located just downstream of the 36 Lane wasteway. The portion of the water to be

used for augmentation purposes will be diverted from the ditch at the newly constructed wasteway

near Southwest Ready Mix and will be measured and returned to the Arkansas River. The remainder

of the water diverted from the Arkansas River will be conveyed down the ditch for irrigation use.

Each month an accounting will be made of the total diversions at the Excelsior Ditch headgate, the

amount returned to the Arkansas at the augmentation station and the amount used for irrigation.

G:\3 ] 77_ 003\REPOR TS\AGUA97 _]_RPT

19

PrinledFebruary27,1997
