<br />cover the direct costs associated with completing <br />foreclosure proceedings against a delinquent borrower <br />from either the Colorado water conservation board <br />construction fund or the severance tax trust fund <br />perpetual base account. The moneys in the foreclosure <br />fund are hereby continuously appropriated to the board <br />for loan foreclosure proceedings, including, but not <br />limited to, property management costs, appraisals, <br />assessments, taxes, local government fees, insurance <br />costs, court costs, and legal fees. All interest derived <br />from the investment of moneys in the foreclosure fund . <br />shall be credited to the Colorado water conservation <br />board construction fund. Any balance remaining in the <br />foreclosure fund at the end of any fiscal year shall <br />remain in the fund. <br /> <br />37-60-123.2. Flood response fund - created. There is <br />hereby created in the state treasury the flood response <br />fund, referred to in this section as the "response fund". <br />The state treasurer is hereby authorized and directed to <br />transfer one hundred fifty thousand dollars from the <br />Colorado water conservation board construction fund to <br />the response fund. The Colorado water conservation <br />board is authorized to provide funding for flood <br />preparedness and for response and recovery activities <br />following flood events and disasters. The moneys in the <br />response fund are hereby continuously appropriated to <br />the board for flood response purposes, including, but not <br />limited to, the immediate availability of funds for aerial <br />photography of flooded areas, flood documentation and <br />identification of specific hazards, evaluations and <br />revisions of floodplain designations, flood forecasting <br />and preparation, and development of disaster and <br />recovery mitigation plans. All interest derived from the <br />investment of moneys in the response fund shall be <br />credited to the Colorado water conservation board <br />construction fund. Any balance remaining in the <br />response fund at the end of any fiscal year shall remain <br />in the fund. <br /> <br />37-60-123.5. Agricultural emergency drought response. <br />(1) If, pursuant to federal or state law, any portion of <br />Colorado has received emergency drought designation <br />or a disaster emergency has been proclaimed due to <br />drought, notwithstanding the provisions of section 39- <br />29-109 (1) (a), C.R.S., in addition to any other moneys <br />appropriated from the perpetual base account of the <br />severance tax trust fund, creat~d by section 39-29-109, <br />C.R.S., up to one million dollars in the perpetual base <br />account of the severance tax trust fund are continuously <br />appropriated to the director of the Colorado water <br />conservation board and the state engineer annually per <br />such designation or proclamation to make loans and <br />grants to agricultural organizations for emergency <br />drought-related water augmentation purposes. <br />(2) The director of the Colorado water <br />conservation board and the state engineer shall consult <br />with the commissioner of agriculture and the executive <br />director of the department of natural resources before <br />making any loans or grants pursuant to this section. <br /> <br />Within three months after the end of any fiscal year <br />during which the spending authority created pursuant to <br />this section is exercised, the director and the state <br />engineer shall report to the general assembly regarding <br />how such spending authority was exercised. <br /> <br />37-60-124. Office of water conservation - creation- <br />powers and duties. (1) There is hereby created as an <br />office under the Colorado water conservation board the <br />office of water conservation. The office shall have such <br />staff as are necessary and appropriate to carry out the <br />duties established for the office. <br />(2) The office of water conservation shall <br />promote water use efficiency by performing, to the <br />degree feasible, duties including, but not limited to, the <br />following: <br />(a) Acting as a repository for water use <br />efficiency information; <br />(b) Provision of technical assistance to and <br />working with municipal and other urban water providers <br />and state agencies as they plan for, evaluate, and <br />implement water use efficiency measures to provide <br />necessary water services; <br />(c) Coordination of the planning for and <br />assistance in the implementation of water use efficiency <br />plans by state agencies pursuant to section 37-96-103 <br />(4); <br />(d) Administration of financial assistance for <br />water use efficiency measures and water use efficiency <br />programs, as authorized in section 37-60-125; and <br />(e) Preparation for review and approval by the <br />board for transmittal to the general assembly such <br />information and recommendations concerning water use <br />efficiency projects and proposed water use efficiency <br />measures by state and local governments, including the <br />analysis of water use efficiency programs already in <br />place. <br />(3) The personal services, operating, travel and <br />subsistence, capital, and legal services expenses of <br />administering the office of water conservation and the <br />programs and activities authorized by subsection (2) of <br />this section may be paid from such moneys as are <br />appropriated, allocated, or otherwise credited to the <br />Colorado water conservation board construction fund. <br />(4) Repealed. <br /> <br />37-60-125. Authorizations for expenditures from <br />Colorado water conservation board construction fund <br />for demonstration of benefits of water efficiency. (1) <br />The Colorado water conservation board is hereby <br />authorized to expend five hundred thousand dollars <br />from the Colorado water conservation board <br />construction fund, notwithstanding the requirements of <br />sections 37-60-119 to 37-60-122, for the purpose of a <br />pilot program demonstrating the benefits of water <br />efficiency measures by providirlg incentive grants, not <br />to exceed fifty thousand dollars to any public agency, <br />established under Colorado law, that requests assistance <br />in the design and implementation of pilot water <br />efficiency and conservation measures. <br /> <br />62 <br />
