<br />temporary solution to an emergency condition must be <br />one that is sensible and functional on its own merits <br />without regard to the prospect offurther state funding. <br />The board shall submit to the general assembly a written <br />determination of the basis for each loan from the <br />emergency fund not later than January 15 of the year <br />following the year in which such loan was made. The <br />moneys in the emergency fund are hereby continuously <br />appropriated to the board for emergency infrastructure <br />purposes consistent with the definition of" emergency" <br />in section 20 (2) (c) of article X of the state constitution, <br />including, but not lirnited to, the immediate availability <br />of moneys for emergency repairs to raw water storage <br />systems, raw water transmission systems, or both such <br />storage and transmission systems. All interest derived <br />from loans and the investment of moneys in the <br />emergency fund shall be credited to the Colorado water <br />conservation board construction fund. Any balance in <br />excess of two million dollars remaining in the <br />emergency fund at the end of any fiscal year shall be <br />credited to the Colorado water conservation board <br />construction fund. <br />(2) Notwithstanding the provisions of section <br />24-6-402, C.RS., in emergency situations in which a <br />majority of the board certifies that exigencies of time <br />require that the board meets without delay for the <br />purpose of considering the need for a loan pursuant to <br />subsection (1) of this section, the requirements of public <br />notice may be dispensed with but the public shall <br />receive notice as soon as is practicable under such <br />exigent circumstances; except that nothing in this <br />subsection (2) shall be construed to relieve the board of <br />the duty to make public notice. <br /> <br />37 -60-122.7. Feasibility study small grant fund - <br />creation. <br />( 1) to (4) Repealed. <br />(5) (a) There is hereby created in the state <br />treasury the feasibility study small grant fund for the <br />purpose of making small grants to help pay the costs of <br />preparing water project feasibility studies. The <br />Colorado water conservation board shall approve small <br />feasibility study grants based solely on criteria adopted <br />by the board. <br />(b) The state treasurer is hereby authorized <br />and directed to transfer two hundred thousand dollars <br />from the Colorado water conservation board <br />construction fund to the feasibility study small grant <br />fund. The moneys in the feasibility study small grant <br />fund are hereby continuously appropriated to the board <br />for grants in compliance with this subsection (5). All <br />interest derived from the investment of moneys in the <br />feasibility study small grant fund shall be credited to the <br />Colorado water conservation board construction fund. <br />Any balance remaining in the feasibility study small <br />grant fund at the end of any fiscal year shall remain in <br />the fund and shall not revert to the Colorado water <br />conservation board construction fund. <br /> <br />37-60-122.8. Publications fund. (1) There is hereby <br />created in the state treasury the publications fund. The <br />fund shall consist of moneys paid to the board from <br />persons outside the board for copies of public records or <br />publications provided by the board. The moneys in the <br />fund may be expended by the board to pay for the cost <br />of providing copies of public records or publications to <br />persons outside the board. The moneys in the fund are <br />hereby continuously appropriated to the board for the <br />purposes established in this section. <br />(2) The publications fund shall have no more <br />than ten thousand dollars in it and any amount in excess <br />shall be credited to the Colorado water conservation <br />board construction fund. All interest derived from the <br />investment of moneys in the publications fund shall be <br />credited to the publications fund. <br />(3) The state treasurer is hereby authorized <br />and directed to transfer five thousand dollars from the <br />Colorado water conservation board construction fund to <br />the publications fund. <br /> <br />37-60-122.9. Colorado river recovery program loan <br />fund - creation. (1) There is hereby created in the state <br />treasury the Colorado river recovery program loan fund <br />for the purpose of making loans to the Colorado river <br />and San Juan river recovery programs for the <br />construction or improvement of certain water related <br />projects in Colorado, under agreements with power <br />users of the federal Colorado river storage proj ect, <br />required to recover the four endangered fish species of <br />the upper Colorado river, including the San Juan river. <br />(2) The Colorado water conservation board <br />shall recommend loans from the Colorado river <br />recovery program loan fund to the general assembly <br />pursuant to section 37-60-122 (1) (b). The loans shall <br />be subject to an interest rate and repayment provisions <br />to be determined by the Colorado water conservation <br />board. <br />(3) The state treasurer is hereby authorized <br />and directed to transfer to the Colorado river recovery <br />program loan fund, created in subsection (1) of this <br />section, out of any moneys in the Colorado water <br />conservation board construction fund not otherwise <br />appropriated, the sum of two million dollars. Interest <br />earned on the funds in the Colorado river recovery <br />program loan fund shall be credited to the Colorado <br />water conservation board construction fund, created in <br />section 37-60-121 (1). <br /> <br />37-60-123. Conformity with state water plan. <br />(Repealed) <br /> <br />37-60-123.1. Loan foreclosure fund - created. There is <br />hereby created in the state treasury the loan foreclosure <br />fund, referred to in this section as the "foreclosure <br />fund". The state treasurer is hereby authorized and <br />directed to transfer one hundred thousand dollars from <br />the Colorado water conservation board construction <br />fund to the foreclosure fund.
